SUBJECT: Abandonment of a Portion of Storm Easement located on the east
property line of 7108 Spring Walk Drive
INITIATED BY: Donna Newman, Engineering Department
Recommendation: Approval is requested to execute a Quit Claim Deed to Timothy
Potter and Tamitha Moore for abandonment of a fifteen (15) foot wide section
along the western side of the existing twenty-five (25) foot storm easement of
Lot 37, Block "A" Riegel Pointe, Phase One Subdivision.
Background: Timothy Potter and Tamitha Moore, owners of 7108 Spring Walk
Drive submitted a request for a building permit to the Inspection and Codes
Department in order to have a swimming pool installed at which time he found
out that the structure and concrete pool surround would fall fifteen (15) feet
onto a storm easement. The Engineering Department was contacted and agrees to
the abandonment of a (15) foot section of the existing storm easement running
northerly from the south property line approximately 81.0 feet as shown on the
highlighted plat.
Analysis: Timothy Potter and Tamitha Moore, owners of 7108 Spring Walk Drive
submitted a request for a building permit to the Inspection and Codes
Department in order to have a swimming pool installed at which time he found
out that the structure and concrete pool surround would fall fifteen (15) feet
onto a storm easement. After checking, the Engineering Department found no
present or future use of that portion of the existing storm easement and is in
agreement that a fifteen (15) foot wide section along the western side of the
existing twenty-five (25) foot storm easement running northerly from south
property line approximately 81.0 feet can be abandon. The remainder of the
storm easement of record located on Lot 37, Block "A" Riegel Pointe, Phase One
Subdivision remains in effect and provides appropriate width as required,
repealing any conflicting ordinances, and for other purposes.

Legal Considerations: The Council must approve the action by resolution.
Recommendations/ Actions: Authorizing the City Manager to execute a Quit Claim
Deed to Timothy Potter and Tamitha Moore for abandonment of a fifteen (15) foot
wide section along the western side of the existing twenty-five (25) foot storm
easement of Lot 37, Block "A" Riegel Pointe, Phase One Subdivision in order to
construct a swimming pool and concrete surround.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO EXECUTE A
QUIT CLAIM DEED TO TIMOTHY POTTER AND TAMITHA MOORE FOR A PORTION OF THE
EXISTING STORM EASEMENT AS SHOWN LOCATED AT 7108 SPRING WALK DRIVE ON THE PLAT
ENTITLED LOT 37 RIEGEL POINTE (7108 SPRING WALK DRIVE) EXHIBIT "B" AND
DESCRIBED ON LEGAL DESCRIPTION EXHIBIT "A" LOCATED IN RIEGEL POINTE, PHASE ONE,
LYING IN LAND LOT 82, 8TH DISTRICT.
WHEREAS, a fifteen (15) foot wide section along the western side of the
existing twenty-five (25) foot storm easement of Lot 37, Block "A" Riegel
Pointe, Phase One Subdivision (7108 Spring Walk Drive) was requested to be
abandon in order to construct a swimming pool and concrete surround; and,
WHEREAS, the aforementioned portion of the existing storm easement is not in
use and is not needed for present or future use; and,
WHEREAS, Columbus, Georgia has no other use for the aforementioned portion of
the existing storm easement. The remainder of the storm easement of record
located on Lot 37, Block "A" Riegel Pointe, Phase One Subdivision remains in
effect and provides appropriate width as required, repealing any conflicting
ordinances, and for other purposes.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That, the City Manager is hereby authorized to execute a quit claim deed to
Timothy Potter and Tamitha Moore for a fifteen (15) foot wide section along the
western side of the existing twenty-five (25) foot storm easement of Lot 37,
Block "A" Riegel Pointe, Phase One Subdivision (7108 Spring Walk Drive) in
order to construct a swimming pool and concrete surround.

Introduced at a regular meeting of the Council of Columbus, Georgia, held
