SUBJECT: Contract for Acquisition of Right of Way Federal or State-Aid

Project for Brown Ave. Bridge



INITIATED BY: Department of Planning





Recommendation: Approval is requested to execute a Contract for

Acquisition of Right of Way, Federal-Aid Project (Non-Reimbursable) for CS

2227/Brown Ave. @Norfolk Southern RailRoad (RR) & @ Bragg Smith St. with the

Georgia Department of Transportation (GDOT) for the replacement and

construction of a new Brown Avenue Bridge Project from Martin Luther King Blvd.

to Cusseta Rd. Project BR000-0004-00(729), Muscogee County, Georgia.



Background: The GDOT and the Consolidated Government of Columbus,

Georgia propose to construct and replace the Brown Ave. Bridge over the Norfolk

Southern RR Tracks. The current Bridge is beyond repair and has been rated by

the GDOT as an unsafe Bridge with a recommendation to reduce the weight limit

to 4 Tons. The City is responsible for the acquisition of Right of Way and

will not be reimbursed by the GDOT.



Analysis: The attached agreement is made and entered into by and between

the GDOT and the City for the purpose of the city to acquire Right of Way on

the parcels along said Project.



Financial Considerations: Funding for said project will be funded under SPLOST

not to exceed $500,000.



Projected Annual Fiscal Impact Statement: Normal street maintenance as

required.



Legal Considerations: Council must approve the action by resolution.



Recommendations/ Actions: Approve the Resolution authorizing the execution of

the Contract for Acquisition of Right of Way,Federal or State -Aid Project

(Non-Reimbursable) for CS 2227/Brown Ave. @ Norfolk Southern RR & Bragg Smith

St. and subsequent agreements necessary to implement the project with GDOT for

the construction/replacement of Brown Ave. Bridge over Norfolk Southern RR

tracks, Project # BR000-0004-00(729), Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR ACQUISITION OF

RIGHT OF WAY, FEDERAL OR STATE -AID (NON-REIMBURSABLE) FOR CS 2227/BROWN AVE.@

NORFOLK SOUTHERN RAILROAD @ BRAGG SMITH STREET WITH THE GEORGIA DEPARTMENT OF

TRANSPORTATION (GDOT) FOR THE CONSTRUCTION AND REPLACEMENT; PROJECT NO.

BR000-0004-00(729).

WHEREAS, this agreement is made and entered into by and between GDOT and the

Consolidated Government of Columbus, Georgia (City); and,

WHEREAS, the GDOT and the City propose to let for construction/replacement of

the above mentioned project; and,

WHEREAS, the City is required to acquire Right of Way on the above referenced

project and will not be reimbursed by GDOT; and,

WHEREAS, fund will be available under the SPLOST funding not to exceed

$500,000; and,

WHEREAS, all procedures and policies depicted in the Contract will be adhered

to.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the Mayor is hereby authorized to execute a Contract for Acquisition of

Right of Way, Federal or State-Aid Project (Non-Reimbursable) for CS2227/Brown

Ave.@Norfolk Southern Railroad @ Bragg Smith St., and subsequent agreements

necessary to implement the project with the Georgia Department of

Transportation for the construction/replacement of Brown Ave. Bridge; Project

No. BR000-0004-00(729).
