MAYOR & COUNCIL REFERRALS/RESPONSES
FOR COUNCIL MEETING OF SEPTEMBER 27, 2011
TO THE CITY ATTORNEY:
1. RESOLUTION FOR JUDGE AARON COHN:
Have the staff to prepare a resolution for Judge Aaron Cohn?s retirement and
years of service, as well as him being the longest serving Juvenile Court Judge
in the Nation. (Request of Councilor Barnes)
Response:
This resolution was presented to Judge Cohn at the Mayor?s
Proclamation/Resolution Session on Tuesday, October 6, 2011.

TO THE CITY MANAGER:
2. ALCOHOLIC BEVERAGE ORDINANCES:
Have the staff to put these ordinances on a Work Session Agenda and let?s
dedicate that Work Session to discuss these particular items. (Request of
Councilor Henderson)
Have the staff to look at putting this matter on the next Work Session Agenda.

Also, let?s look at this proposed Sub-section (I) and let?s make sure that we
are not creating an opportunity for someone to have a temporary nightclub
somewhere. (Request of Councilor Henderson)
If there is a concern from the food industry side or catering businesses prior
to the Council?s Work Session, or if there are some issues; whether it be
clarification, or just education, let?s have the staff to get with some of
these groups or businesses out in the community and talk to them to see if
there is any areas that we might need to discuss or go over in our Work
Session. (Request of Councilor Davis)
Response:
A resolution for a Special Called Council meeting is listed on the Clerk of
Council?s Agenda for approval. The recommendation is to have the Special
Called Meeting on Tuesday, October 18, at 9:00a.m.

3. PERMANENT EASEMENT FOR CONVEYOR OVER FORTSON ROAD:
Have the staff to look at doing something other than a permanent easement,
possibly considering a 50 or 60-year agreement, as well as having inspections.

Have the staff to provide a picture of another conveyor for the Council to look
at. Also, when looking at the MOU, let?s make sure that there are some
standards that we (City) expect Vulcan to meet for this to continue; and let?s
reassess it periodically. (Request of Councilor Thomas)
Also, let?s look at an abandonment clause. (Request of Mayor Tomlinson)

Response provided by Ron Hamlett, Traffic Engineering Manager:
10-5-11 Contacted Dave Petty, Vulcan Engineer who made the request to develop
an Aerial Easement Agreement. We are working to development an easement
agreement for their review. Mr. Petty provided the photo below of the type of
conveyor crossing that they are requesting.
Staff will provide an amended agenda report outlining the conditions of the
easement as requested by Council. Vulcan will provide photographs of similar
conveyor systems in operation at other plants and a concept plan of the
proposed installation.

4. INFORMATION SENT TO ELECTED OFFICIALS:
Have the staff to get together with the IT Department to make sure that the
Council members are included with emails that go out to all of our elected
officials. (Request of Mayor Tomlinson)

5. CLERK OF RECORDER?S COURT:
Have the staff to look at developing some guidelines as to the appointment
process fro the Clerk of Recorder?s Court. (Request of Mayor Pro Tem Turner
Pugh))

The Clerk of Recorder?s Court position was confirmed by vote of Council
Tuesday, September 27, 2011.
TO THE CLERK OF COUNCIL
6. BOARD OF TAX ASSESSORS:
Have the staff to check with the Chief Tax Assessor, to determine whether or
not there were any specific issues as to the two registrations from the board.

Response provided by Betty Middleton, Chief Appraiser Muscogee County Board of
Tax Assessors:
Scott Boyce failed to attend a 40 hour training class as required by the GA
Code 48-5-291(a)(4). When Chairman Lawton Grantham advised Mr. Boyce that he
would not be able to participate in the meetings until he attended the 40 hour
training class. Mr. Boyce said due to the time away from his one person office
and the change in his Mother's health, he felt he should resign so someone
could be appointed that would have the time required. He sent his resignation
letter to Ms. Washington.
Mrs. Ann Grantham resigned due to a change in her Mother's health. Her Mother
has become homebound with assistance of Hospice. Mrs. Grantham and her sisters
are having to be with her Mother in 24 hour shifts and the stress is more than
anticipated. Also, Mrs. Grantham's husband is a disabled veteran and requires
her care.
