REGULAR MEETING - 2:00 P.M. ? MAY 3, 2006





The Regular Meeting of the Board of Zoning Appeals was held Wednesday, May 3,

2006 at 2:00 P.M., on the 1st Floor of the Government Center Annex in the

conference room, 420-10th Street. Mr. David Fox, Chairman, called the meeting

to order. The board members present were:



Mr. Billy Edwards

Mr. Ralph King

Mr. Perry Borom

Mr. Willie Lewis Jr.



Also present representing the Inspections and Code Enforcement Division was Mr.

Danny Cargill, Secretary of the Board, and Mrs. Millicent Burden, Recording

Secretary. Also, Ms. Aronda Smith, representing the Planning Division.



VARIANCES:



Case No. 06-V47?-Granted:

Janice A. Johnson and Gerald Richardson, 554 Honolulu Drive, presented the

appeal for a variance to reduce the rear setback requirement from 30 ft to 12

ft to add a garage. The property is zoned SFR2.



Ms. Johnson stated that she desires to add a two car attached garage onto the

back of the home. Similar materials will be used for the addition and the roof

will be gabled.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Edwards, to grant this

appeal. Motion carried unanimously.



Case No. 06-V48--Granted:

Michael Corradino, 1029 Christmas Court, presented the appeal for a variance to

reduce the side yard setback requirement from 25 ft to 15 ft to erect a

detached garage. The property is zoned RE1.



Mr. Corradino stated that he plans to construct a detached garage that will

measure 23? x 32?. The materials used will match the existing home.





There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this

appeal. Motion carried unanimously.



Case No. 06-V49--Granted:

Dave Richardson, of Richardson Contracting Co., 8125 Woodfern Drive, presented

the appeal for a variance to reduce the rear setback requirement from 30 ft to

25 ft to add a covered patio. The property is zoned SFR3.



Mr. Richardson stated that he is adding on to an existing structure in the

rear. He also stated that he will have gutters to assist with the water

drainage and the materials will match the existing home.



Mr. Fox noted that this lot has strange configurations, which makes the

variance request necessary.



Mr. Edwards made a motion to grant the appeal, which was seconded by Mr. Lewis,

to grant this appeal. Motion carried unanimously.



Case No. 06-V50--Denied:

Johnnie Senior and Steve Thorpe, of J & S Construction, 6900 Forrest Road,

presented the appeal for a variance to reduce the minimum lot width from 75 ft

to 25 ft. The property is zoned SFR2.



Mr. Thorpe stated that since the lot was so deep, he is trying to cut a lot out

of it due to the fact that in the rear of the lot, it drops off. He also

mentioned that Mr. Senior lives in another location further away from town and

he would like to have this lot to build a home for his daughter and to have a

convenient location in the city.



The Planning Division recommended denial with various reasons, which are stated

in their staff report.



There was no opposition presented to this appeal.



Mr. Lewis made a motion, which was seconded by Mr. King to deny this appeal.

Motion carried unanimously.



Case No. 06-V51--Granted:

Jorge Vega and Les Talley, 1225 35th Street, presented the appeal for a

variance to reduce the side yard setback requirement from 5ft to 2 ft; for a

variance to erect an accessory structure in the side yard; and for a variance

to reduce the distance between structures from 6 ft to 2 ft 7 in. The property

is zoned RMF1.



Mr. Vega stated that he plans to erect a carport that will match the existing

house. Mr. Les Talley has been contracted to do the work. He (Mr. Vega) spoke

with the surrounding neighbors personally and they voiced no objection to the

variance request. The design of the house will be accented by this addition.

When asked why he could not attach the carport to the house, Mr. Talley

explained the circumstances regarding the steps and the maneuvering required.



There was no opposition presented to this appeal.



Mr. Lewis requested an amendment to the request to add gutters.



Mr. Edwards made a motion, which was seconded by Mr. King to grant this appeal

with the amendment. Motion carried unanimously.

Case No. 06-V52?-Granted:

Sandy Basch of D&S Signs represented Steven W. Corbett, 4350 Warm Springs Road,

presented the appeal for a variance to allow a second ground sign measuring 64

sq. ft on the back of the property. The property is zoned GC.



Mr. Basch stated that the sign is a single face 96?x96? sign which will allow

them to have advertising on the Manchester Expressway side. He also stated

that he mentioned to the appellant that the sign was fairly large.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal.

Motion carried unanimously.



Case No. 06-V53--Granted:

Robert Teasley of Signs Inc., 7042 Moon Road, presented the appeal for a

variance to increase the height of the sign from the 20 ft allowed to 32 ft and

to change the square footage from 150 ft to 180 ft. The property is zoned RO.



Mr. Teasley stated that they are requesting to increase the height of the sign

due to pedestrian traffic and the electronic messaging board requires the

additional square footage. This will be a replacement sign and not an addition.



There was no opposition presented to this appeal.



Mr. Lewis made a motion to grant the appeal, which was seconded by Mr. Borom.

Motion carried unanimously.





Case No. 06-V54--Granted:

Jimmy Weaver, of A-Airflow Awning, 341 Wickham Drive, presented the appeal for

a variance to reduce the side yard setback requirement from 8 ft to 1.6 ft to

erect a carport. The property is zoned SFR2.



Mr. Weaver presented photographs to the board to assist them in the visual

aspect of the request. The appellant is requesting the variance to protect his

vehicles from the elements and enclosing the carport due to the dogs next door,

which have become a nuisance. Gutters will be installed in the front and back

of the carport.



There was no opposition presented to this appeal.



Mr. Edwards made a motion to approve the appeal with the stipulation that

gutters will be installed, which was seconded by Mr. Lewis. Motion carried

unanimously.



Case No. 06-V55--Granted:

James Johnson of Neighbor Works Columbus, 810 Washington Avenue, presented the

appeal for a variance to reduce the rear setback requirement from 30 ft to 24

ft. The property is zoned SFR4.



Mr. Johnson stated that they would like to build two story houses on the lots,

which were developed for them. This lot measures 24.2 ft to the rear instead

of the required 30 ft. If he tried to make the house fit in another angle, it

would sit back too far.



There was no opposition presented to this appeal.



Mr. Edwards made a motion to grant this appeal, which was seconded by Mr.

King. Motion carried unanimously.



Case No. 06-V56--Granted:

Wright Wade of W. W. Wade Co., Lot 10 Blois Court, presented the appeal for a

variance to reduce the rear yard setback requirement from 30 ft to 10 ft to

construct a single-family residence. The property is zoned SFR2.



Mr. Wade presented the board with copies of the letters that he sent to the

adjacent property owners giving his intention for the variance. The lot is odd

shaped and he desires to have the front of the house to face the cul-de-sac.

He currently owns Lot 9 as well and does not see any problem with the request.

This would be the first house in the neighborhood with this type of request.



There was no opposition presented to this appeal.





Mr. Edwards made a motion to grant the appeal, which was seconded by Mr.

Borom. Motion carried unanimously.



Case No. 06-V57--Granted:

Warren Mason and Darlene Corbitt of the Grand Reserve Apartments, 1716 Fountain

Court, presented the appeal for a variance to reduce the front yard setback

requirement from 25 ft to 14 ft. The property is zoned RO.



Mr. Mason stated that he submitted the variance request so that they can

complete construction of a pool in the complex. In the current zoning, a pool

is considered an accessory structure and has a different setback requirement.

The pool was also submitted in the original site plan.



There was no opposition presented to this appeal.



Mr. King made a motion to grant the appeal, which was seconded by Mr. Edwards.

Motion carried unanimously.



Case No. 06-V58--Granted:

Bill Hart, 5501 River Rock Court, presented the appeal for a variance to reduce

the front yard setback requirement from 25 ft to 19 ft. The property is zoned

SFR3.



Mr. Hart stated that this is a 30-lot subdivision that they have developed.

The houses had to be shifted forward because the rear falls off and limits the

area to build on.



Mr. Edwards made a motion to grant the appeal, which was seconded by Mr.

Borom. Motion carried unanimously.



Case No. 06-V59--Granted:

Bill Hart, 5505 River Rock Court, presented the appeal for a variance to reduce

the front yard setback requirement from 25 ft to 17 ft. The property is zoned

SFR3.



Mr. Hart stated that this is a 30-lot subdivision that they have developed.

The houses had to be shifted forward because the rear falls off and limits the

area to build on.



Mr. Edwards made a motion to grant this appeal, which was seconded by Mr.

Lewis. Motion carried unanimously.





END OF VARIANCES







Mr. King made a motion to accept the minutes of the regular meeting of April 5,

2006 for approval as written, which was seconded by Mr. Lewis. Motion carried

unanimously.



Mr. King made a motion to name Mr. David Fox as chairman of the board, which

was seconded by Mr. Lewis. Motion carried unanimously.



Mr. King made a motion to name Mr. Billy Edwards as vice-chairman of the board,

which was seconded by Mr. Lewis. Motion carried unanimously.



There being no further business to come before the Board, the meeting adjourned

at 4:03 p.m.
