Planning Advisory Commission's Recommendation: Approval to remove Condition #5 of Ordinance

04-68, which states: a 100-foot natural buffer shall be preserved by the

developer from the eastern property line of the property subject to rezoning.

Buffer Requiremnts

The proposed development shall have a Category C buffer requirement along all

property lines bordered by the SFR3 zoning district. The 3 options under

Category C are:

1) 20 feet with a certain amount of canopy trees, understory trees, and shrubs

/ ornamental grasses per 100 linear feet

2) 10 feet with a certain amount of shrubs / ornamental grasses per 100 linear

feet and a wood fence or masonry wall

3) 30 feet undisturbed natural buffer.



Attitude of Property Owners: Sixty-five (65) property owners within 300 feet were

notified of the rezoning request. The Planning Department received comments

opposing and supporting the rezoning request. The Planning Department also

received a petition opposing the rezoning.



Additional Information: The property was rezoned in 2004 from R-1 (now SFR1) to A-O (now RO)

for a proposed office development. On July 13, 2004, Council asked for a

one-week delay so the applicant could assess whether or not a substantial

buffer could be offered on the eastern property line (due to the depth of the

lot). The applicant returned on July 20 and stated that he could offer a

100-feet deep buffer on the east property line. Councilor Allen made a motion

to make the 100-foot buffer a condition of the ordinance, seconded by Councilor

Henderson, and approved unanimously by Council.



The Planning Advisory Commission approved removal of Condition #5 by a vote of

4 to 3.
