SUBJECT: Right-of-way Encroachment for Columbus State University College of
Education and Health Professions
INITIATED BY: Department of Engineering
Recommendation: Approval is requested to approve a right-of-way encroachment
for a new Columbus State University (CSU) academic building at 1127 Broadway.
The encroachment will allow a portion of the building?s subsurface footings to
extend into the rights-of-way of Broadway and 12th Street. The encroachment
will also allow an attached overhead canopy to extend into the same
rights-of-way.
Background: CSU desires to construct a new College of Education and Health
Professions building at the southwestern corner of the intersection of Broadway
and 12th Street. This site is presently occupied by a portion of the former
Columbus Ledger-Enquirerfacility, which will be demolished to allow the
construction of the new CSU building.
On January 12, 2015, the Board of Historic and Architectural Review issued a
Certificate of Appropriateness to CSU Foundation Properties, Inc., for the
purpose of demolishing the Page Building, warehouse, press bay, and loading
docks that were part of the Ledger-Enquirer facility.
On January 19, 2015, the Uptown Fa?ade Board issued a Certificate of
Appropriateness to CSU Foundation Properties, Inc. for construction of the new
academic building with no front setbacks and a canopy encroachment into the
Broadway and 12th Street rights-of-way. The building?s eastern face will
extend to the western right-of-way margin of Broadway and its northern face
will extend to the southern right-of-way margin of 12th Street. In order to
adequately support the area of the building placed against the right-of-way
boundary, the subsurface footings must encroach into the right-of-way. The
maximum encroachment distance for the footings is approximately two feet. The
footings for this building will be constructed so they are located entirely
below ground and, once the sidewalk has been replaced, will not be visible.
The design of the new building also includes a canopy that will extend
approximately six feet from the building face onto the rights-of-way of
Broadway and 12th Street and over the sidewalk. The height of the canopy will
be approximately 44 feet above the sidewalk. The canopy will extend along both
rights-of-way approximately 70 feet to the south and 70 feet to the west from
the Broadway/12th Street intersection.
Attached for your review are the following drawings from the architect:
? A1 is a plan view of the project site that shows the new CSU building and the
existing building that will remain.
? A2 is an enlarged plan view of the new building. The proposed encroachment
areas along the eastern and northern sides of the building are shaded.
? A3 is a typical wall section of the building that shows the cantilevered roof
canopy over the sidewalk.
Analysis: N/A
Financial Considerations: There are no financial requirements for the City.
All sidewalk demolition necessary to install the building?s footings shall be
replaced by the building contractor. There is also a provision in the
resolution that the building owner shall remove all encroachments at no cost to
the City should the encroachments conflict with any future public improvements
within the rights-of-way.
Projected Annual Fiscal Impact Statement: N/A
Legal Considerations: For the building?s footings and canopies to be
constructed as proposed, a permanent encroachment resolution must be approved
by Council.
Recommendations/ Actions: Engineering staff recommends Council approve the
Resolution as presented.

A RESOLUTION AUTHORIZING A PERMANENT ENCROACHMENT ONTO THE WESTERN RIGHT-OF-WAY
MARGIN OF BROADWAY AND THE SOUTHERN RIGHT-OF-WAY MARGIN OF 12TH STREET FOR THE
EASTERN AND NORTHERN BUILDING FACES OF THE COLUMBUS STATE UNIVERSITY COLLEGE OF
EDUCATION AND HEALTH PROFESSIONS LOCATED AT 1127 BROADWAY A DISTANCE NOT TO
EXCEED SIX FEET; AUTHORIZING THE SUBSURFACE CONCRETE FOUNDATION AND THE
OVERHEAD CANOPY TO ENCROACH INTO SAID RIGHTS-OF-WAY.
WHEREAS, Columbus State University desires to construct a new College of
Education and Health Professions building at 1127 Broadway, which is more
specifically located at the southwestern quadrant of the intersection of
Broadway and 12th Street; and,
WHEREAS, the current zoning regulations allow the building to be constructed
with a zero setback line on both the Broadway and 12th Street sides; and,
WHEREAS, the subsurface footings for the building must extend into the
right-of-way on both the Broadway and 12th Street sides in order to provide
adequate structural stability; and,
WHEREAS, an overhead canopy is also incorporated into the architectural design
of the building that will encroach into the right-of-way on both the Broadway
and 12th Street sides; and,
WHEREAS, Certificates of Appropriateness for the canopy encroachment have been
issued by the Uptown Fa?ade Board and the Board of Historic and Architectural
Review; and,
WHEREAS, the Engineering Department recommends approval of this request,
subject to the understanding by all parties that the encroachments shall be
removed at no cost to the City if public improvements within the Broadway
and/or 12th Street rights-of-way require their removal.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That a permanent Encroachment into the western right-of-way margin of Broadway
and the southern right-of-way margin of 12th Street is hereby authorized for
the eastern and northern building faces of the Columbus State University
College of Education and Health Professions, located at 1127 Broadway, a
distance not to exceed six (6) feet, such encroachments being the subsurface
concrete foundation and overhead canopy, as shown on the attached Exhibits
?A1?, ?A2?, and ?A3?.
