Dear Mayor Tomlinson:



I hope you?re well. As promised, I am following-up on our conversation about

the FACT Act. Attached is the draft of the Full Accountability in Collection

of Taxes (FACT) Act as put in bill form by the Office of Legislative Counsel.



As I mentioned early last week, a member of the Ways & Means Committee is the

lead sponsor ? Chairman Paul Battles (R ? Cartersville). We would really like

to have as many House members sign on to the bill and would appreciate you have

the time to help generate interest in co-sponsors from the Columbus

Delegation. We completely understand that this proposal will likely change

through the legislative process, and hopefully its initial momentum will lead

to a measure that can benefit local governments.



There aren?t many developments to report since our call, but here are a couple

of items of note:



? GMA?s tax lobbyist Michael McPherson met with Ways & Means Committee

Chairman Mickey Channell and his staff last week to brief him on the measure,

and the Chairman has an open mind about the bill at this point;

? I met with Speaker Ralston?s chief of staff and General Counsel to go

over the proposal this past Tuesday and they understand the concerns we are

trying to address with the FACT Act;

? The Department of Revenue staff met to begin to ascertain what

administrative costs, of any, may fall on the Department based on the different

components of the bill. We don?t have a timeline yet on when DOR will settle

on any cost estimates, but will follow-up with DOR staff; and

? We talked with Association County Commissioners Association staff

about the proposal (we shared the draft bill with them too) and plan to sit

down with them to hear any concerns or suggestions that they have to improve

upon the bill.



In addition, Chairman Battles has been talking with colleagues about the FACT

Act, but we have not heard any details from those conversations at this point.
