SUBJECT: Property Disposition ? 0.040 +/- Acres on Bull Creek Watershed

Recommendation: Approval is requested to declare as surplus and authorize to

execute a Quit Claim Deed to the adjacent property owner(s) for a portion,

0.040 +/- acres, of the Bull Creek Watershed #12 a/k/a Tax Map 081 022 005,

near Stable Drive (see attached map marked in yellow), in Columbus, Muscogee

County, Georgia.



Background: Bull Creek Watershed Structure Number 12 was obtained by Muscogee

County in 1963. The 0.040 +/- acres is on the edge of the watershed near

Stable Drive and is not part of the storage area. The previous owner of 6963

Stable Drive built a concrete carport on the City?s property without building

permits. The present owner would like to sell the property but cannot because

the carport is not on their property. The City declaring the property surplus

and the execution of a Quit Claim Deed will allow the present property owner to

sell the property and carport.



Analysis: It has determined that the City will not need the above property in

the foreseeable future. Transfer of the property will be subject to

reservation of all existing utility easements of record, known and unknown.



Financial Considerations: The property will be sold at Fair Market Value. The

fair market value has been determined to be $2,000. The property and any

related improvements would be returned to the tax digest roles.



Legal Considerations: Council must approve to declare the property surplus, the

sell of said property, and the execution of a Quit Claim Deed by the City

Manager.



Recommendations/ Actions: Declare the property as surplus and authorize to

execute a Quit Claim Deed to the adjoining property owner(s) for the Fair

Market Value of the section of 0.040 +/- acres.

A RESOLUTION AUTHORIZING TO DECLARE 0.040 +/- ACRES A PORTION OF BULL

CREEK WATERSHED #12 A/K/A TAX MAP #081 022 005 NEAR STABLE DRIVE AS SURPLUS AND

TO AUTHORIZE TO EXECUTE A QUIT CLAIM DEED TO THE ADJOINING PROPERTY OWNER

COLUMBUS, MUSCOGEE COUNTY, GEORGIA.



WHEREAS, the adjacent property owner is on Stable Drive; and,



WHEREAS, the previous property owner built a concrete carport on City

property; and,



WHEREAS, the City property consist of 0.040 +/- acres of the Bull Creek

Watershed #12 a/k/a Tax Map #081 022 005; and,



WHEREAS, it has been determined the fair market value of the property

is $2,000; and,



WHEREAS, the present property owner would like to sell their

property; and,



WHEREAS, it has been determined to be in the best interest of the

Consolidated Government of Columbus, Georgia to sell the property to the

adjoining owner on Stable Drive.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



That the City Manager is hereby authorized to:



1. Declare City owned property 0.040 +/- acres of Bull Creek Watershed

#12 a/k/a Tax Map # 081 022 005 as surplus; and,



2. Sell said property for Fair Market Value to the adjacent

owner(s) on Stable Drive with the transfer subject to reservation of all

existing utility easements or record, known and unknown; and,



3. Execute a Quit Claim Deed to the adjoining property owner and,



4. Authorize the Community Reinvestment Department to file said

Deed with the Clerk of Superior Court.
