SUBJECT: Utility Easement for Installing and Maintaining Traffic Signal



INITIATED BY: Donna W. Newman, Director of Engineering







Recommendation: Approval is requested to enter into a utility easement

at 2345 Wynnton Road with Eastern Property Development, LLC for $2,750, the

fair market value of the easement in the area as determined by the right of way

acquisition consultant for the City. Funds are available in the Paving Fund CIP.



Background: On September 8, 2009 by Resolution Number 315-09, Council

authorized the application and acceptance of grant under The American Recovery

and Reinvestment Act of 2009 (ARRA) via the U.S. Department of Energy (DOE) in

which the City was allocated $1,844,800.



Analysis: With part of the grant funds, the City allocated $1,000,000 for the

Macon Road ATMS project which included the installation of Fiber Optic Signal

Interconnect to tie the signal system to the new TCC (Traffic Coordination

Center). The interconnect services 18 traffic signals. The program was to

upgrade 5 intersections with new signals and black mast arm strain poles. Due

to the many conflicts with existing utilities at the intersection of Wynnton

Road and Lawyers Lane we will need to install a portion of the system to

include Strain Poles and Mast Arms on private property.



Financial Considerations: The property owners have requested payment of $2,750

for the execution of the easement. The $2,750 represents the fair market value

of an easement in the area as determined by the right of way acquisition

consultant for the City . Funds are available in the Paving Fund CIP account

20758 Traffic Signalization 2012.



Projected Annual Fiscal Impact Statement: The system will be part of the normal

operating maintenance as provided by the Traffic Engineering Division.



Legal Considerations: The execution of easements and payment of funds required

Council authorization.



Recommendations/ Actions: Approve the resolution authorizing the City Manager

to execute a utility easement at 2345 Wynnton Road with Eastern Property

Development, LLC. and payment of $2750.00 to the same.

















A RESOLUTION

A RESOLUTION AUTHORIZING THE EXECUTION OF A UTILITY EASEMENT AT 2345 WYNNTON

ROAD WITH EASTERN PROPERTY DEVELOPMENT, LLC., FOR $2,750, THE FAIR MARKET VALUE

OF THE EASEMENT IN THE AREA FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF

TRAFFIC SIGNAL EQUIPMENT.

WHEREAS, a project for the installation of fiber optic signal interconnect

along Macon/Wynnton Road and the upgrade of signal materials and equipment for

five intersections was implemented under a grant funded by The American

Recovery and Reinvestment Act; and,

WHEREAS, due to the conflict with existing utilities a portion of the signal

system located at Lawyers Lane and Wynnton Road is required to be installed on

private property; and,

WHEREAS, the property owners at 2345 Wynnton Road are in agreement with the

execution of the utility easement.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute a utility

easement with Eastern Property Development, LLC. and payment of $2,750 for an

easement for the installation, operation and maintenance of a traffic signal

system at 2345 Wynnton Road. Funds for the easement are available in the

Paving Fund CIP Traffic Signalization Account 20758.
