SUBJECT: Supplemental Agreement with Fort Benning
INITIATED BY: Donna W. Newman, Director of Engineering
Recommendation: Approval is requested to execute a supplemental agreement for
continuing authority for storm sewer, ditch and drainage facilities on Federal
Government owned land at Fort Benning, Georgia.
Background: An easement for a storm sewer, ditch and drainage facilities was
executed on May 2, 1960 for a period of 50 years on what was referred to as
the Fort Benning Railroad. The facilities are located on property owned by the
Federal Government. Although the property is technically located in Muscogee
County, the easement applies to property on or immediately adjacent to the Fort
Benning Military Reservation.
Analysis: The Department of Engineering was notified in March by
representatives from the Department of the Army the easement needed to be
continued for a period of 5 years. The extension of the easement for the
additional time period would not appear to have an adverse effect on the
Consolidated Government.
Financial Considerations: No funds are required at this time.
Projected Annual Fiscal Impact Statement: The City will continue to maintain
the area as previously performed under the easement.
Legal Considerations: Execution of legal agreements requires Council action.
Recommendations/ Actions: Approve the Resolution authorizing the City Manager
to execute a supplemental agreement for continuing authority for storm sewer,
ditch and drainage facilities on Federal Government owned land at Fort Benning,
Georgia.

A RESOLUTION AUTHORIZING CITY MANAGER TO EXECUTE A SUPPLEMENTAL AGREEMENT FOR
CONTINUING AUTHORITY FOR STORM SEWER, DITCH AND DRAINAGE FACILITIES ON FEDERAL
GOVERNMENT OWNED LAND AT FORT BENNING, GEORGIA.
WHEREAS, an easement for a storm sewer, ditch and drainage facilities was
executed on May 2, 1960 for a period of 50 years; and,
WHEREAS, it is the desire of both parties and considered mutually beneficial to
extend the term of said easement for an additional 5 years.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute a supplemental agreement
for continuing authority for a storm sewer, ditch and drainage facilities on
Federal Government owned land at Fort Benning, Georgia.
