Subject Property Located at 4100 Cusseta Road
Description Have the staff to go back and research the records and pull Council
minutes as it relates to the apartments located at 4100 Cusseta Road where
former City Manager Cavezza may have made some statements regarding this
property and provide the Council with a report. (Request of Councilor Suber)
When the staff does the research, don?t just look at what former City Manager
Cavezza said, because she believes that some of the staff members have told
them that this matter was in the courts. (Request of Councilor Turner Pugh)

Response 11/16/06 - The term ?litigation? was mis-communicated as meaning the
disputes were being settled in court. As it pertained to the discussion of
this project, staff and the previous administration used the term ?litigation?
to refer to the discussions to settle disputes that were being held between the
various attorneys for the City, HUD, the property owner and the construction
companies, etc.
At no time during the project did the City, HUD, contractors and/or Ms.
MacCachlan go to court to settle any disputes that arose. Those disputes were
all handled through negotiations between the various parties and attorneys.
These discussions only involved 50 of the 88 units, which were to be
rehabilitated with $700,000 HUD federal dollars.
The final amount of money expended for the project was $597,357.97 for 40 units
that were located in buildings 8, 9, 10, 11, 12, 17, 18, 19. The 40 units was
a negotiated number of units between the City, HUD and Ms. MacCachlan in order
to complete the project.
