An ordinance providing penalties for violations of any watering ban

issued by the Georgia Department of Natural Resources or Environmental

Protection Division affecting Columbus, Georgia; and for other purposes.

THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:



SECTION 1.



Chapter 13 of the Columbus Code is hereby amended by adding a new

Section 13-342 to read as follows:



(a) It shall be unlawful to violate any watering ban issued by the Georgia

Department of Natural Resources or Environmental Protection Division affecting

Columbus, Georgia. Citations for violation may be issued by any sworn law

enforcement officer, special enforcement officers of the consolidated

government or any Columbus Water Works official designated by the Board of

Water Commissioners. Such citations shall be heard by the Environmental Court

Division of the Recorder?s Court of Columbus, Georgia. Penalties for such

violations shall be imposed as provided in subsection (b) of this ordinance

after provision of one (1) written warning by an official listed in this

paragraph.



(b) (1) Upon conviction of a first offense, a fine of $100.00 shall be imposed.



(2) Upon conviction of a second offense, a fine of $500.00 shall be imposed.



(3) Upon conviction of a third or subsequent offense, the Board of Water

Commissioners shall discontinue water service at the location of such violation

and a fine of $1000.00 shall be paid to the Recorder?s Court before such

service is continued or reconnected.?



SECTION 2.



All ordinances and parts of ordinances in conflict with this ordinance

are hereby repealed.
