A RESOLUTION AUTHORIZING THE MAYOR OF COLUMBUS, GEORGIA TO SIGN A

QUITCLAIM DEED, SUBSTANTIALLY SIMILAR TO THE ONE ATTACHED, WHICH WOULD CONVEY

THE STREET SEGMENT AND RIGHT-OF-WAY OF SINGLETON AVENUE FROM THE EAST

RIGHT-OF-WAY LINE OF BENNING DRIVE EAST TO THE WEST RIGHT-OF-WAY LINE OF FT

BENNING ROAD; PINTA DRIVE FROM THE EAST RIGHT-OF-WAY LINE OF BILBO DRIVE EAST

TO THE WEST RIGHT-OF-WAY LINE OF FT BENNING ROAD; CIRCLE DRIVE FROM THE EAST

RIGHT-OF-WAYLINE OF BENNING DRIVE EAST AND NORTHEASTERLY TO THE SOUTH

RIGHT-OF-WAY LINEOF PINTA DRIVE; BILBO DRIVE FROM THE NORTH RIGHT-OF-WAY LINE

OF CIRCLE DRIVE NORTH TO THE SOUTH RIGHT-OF-WAY LINE OF SINGLETON AVENUE TO THE

HOUSING AUTHORITY OF COLUMBUS, GEORGIA ON BEHALF OF THE CITY.



WHEREAS, the Columbus Council has declared that the following street segments

are surplus and has authorized disposal of said streets to the Housing

Authority of Columbus, Georgia in Ordinance 08-13:

Singleton Avenue from the east right-of-way line of Benning Drive east to the

west right-of-way line of Ft Benning Road;

Pinta Drive from the east right-of-way line of Bilbo Drive east to the west

right-of-way line of Ft Benning Road;

Circle Drive from the from the east right-of-way line of Benning Drive east and

northeasterly to the south right-of-way line of Pinta Drive;

Bilbo Drive from the north right-of-way line of Circle Drive north to the south

right-of-way line of Singleton Avenue; and,



WHEREAS, the Housing Authority of Columbus, Georgia has agreed to create new

streets and rights-of-way on or near said property as part of the redevelopment

of Newton D. Baker Village; and,



WHEREAS, the Housing Authority of Columbus, Georgia has agreed to return title

and possession of said property to the City of Columbus, Georgia upon

completion of redevelopment of Newton D. Baker village; and,



WHEREAS, all existing utility easements of record shall remain in effect and

shall provide appropriate width for applicable utility companies.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:

That the Mayor is hereby Authorized to sign and execute the attached quitclaim

deed, conveying said property to the Housing Authority of Columbus, Georgia.

DEED TO STREETS



STATE OF GEORGIA

COUNTY OF MUSCOGEE



THIS INDENTURE, made as of the 8th day of July, 2008, between COLUMBUS

CONSOLIDATED GOVERNMENT, MUSCOGEE COUNTY, GEORGIA (hereinafter referred to as

Grantor), and THE HOUSING AUTHORITY OF COLUMBUS, GEORGIA (hereinafter referred

to as "Grantee") (the words "Grantor" and "Grantee" shall include their

respective successors and assigns, where the context requires or permits):

W I T N E S S E T H T H A T:



For and in consideration of the sum of Ten Dollars and other good and valuable

consideration in hand paid to Grantor, the receipt whereof is hereby

acknowledged, Grantor has bargained, sold, granted and conveyed and does by

these presents bargain, sell, grant and convey unto Grantee and Grantee's

successors and assigns, the following described real estate, for the uses and

purposes hereinafter set forth:



All those certain strips of land and areas situate, lying and being in the

Seventh District of Muscogee County, Georgia, being those certain avenues and

drives now in existence within the area of development of that certain housing

project of Grantor known as Newton D. Baker Village, said avenues and drives

being shown and designated as Singleton Avenue (Entrance No. 1), Fulton Avenue,

n/k/a Pinta Drive (Entrance No. 2), Center Drive, n/k/a Bilbo Drive, and Circle

Drive on Sheet No. 1 and Sheet No. 2 of that certain map or plat made by Siegel

Engineering Company July 1952, entitled ?Newton D. Baker Village Street Map,

etc.? as recorded in Plat Book 8, Pages 214-A and 214-B of the records in the

Office of the Clerk of Superior Court of Muscogee County, Georgia, reference is

hereby made tot said plat for a more particular description of said streets.



For the same considerations set forth above, Grantor does further grant to

Grantee, Grantee's successors and assigns, the right, in construction and

maintenance of public roads or streets and right-of-way, on the land of

Grantor adjacent thereto, and does further grant, quitclaim and convey unto

Grantee, and its assigns, all of its right, title and interest in and to any

sanitary and public storm sewer easements adjacent thereto and all public

easements for installation and maintenance of utilities and drainage facilities

over and adjacent to the land hereby conveyed and to all necessary drainage

thereon and on the land adjacent thereto.



TO HAVE AND TO HOLD the bargained premises unto Grantee and its successors and

or assigns, together with all and singular the rights, members, and

appurtenances thereunto appertaining, to the same in any manner belong to the

own proper use, benefit and behoof of Grantee and its successors and assigns,

forever and in fee simple.



IN WITNESS WHEREOF, the Grantor has caused this instrument to be executed for

it, and on its behalf, and has caused to be hereunto affixed its corporate

seal, by its proper corporate officers, they being duly authorized, the day and

year first above written.
