Subject: (REZN-2-14-0238) Request to amend the text of the Unified Development

Ordinance (UDO) in regards to the Manchester Expressway Overlay District.





UNIFIED DEVELOPMENT ORDINANCE REVISIONS

(Explanation of Revisions)







1. Explanation of Revisions: Amend by adding a Section 2.5.22.



The Manchester Expressway Overlay District is proposed as additional

requirements for development along Manchester Expressway, from J.R. Allen

Parkway to County Line Road. The proposed ordinance is attached.

A total of two hundred and sixty eight (268) property owners within 1,000 feet

of the subject properties were notified of the rezoning request. The Planning

Department has received approximately seventy four (74) calls/emails in support

of the case, two (2) were neutral and six (6) were in opposition. The ones in

favor agree with not allowing billboards and advertisement and also keep the

unspoiled tree line in the corridor. One of the callers in opposition was

concerned about the overlap between the HWY 80 overlay and the proposed one,

the amount of variances granted on previous overlays and the cost to add those

aesthetic improvements for the property owner/developer. The ones neutral were

inquiring about the purpose of this overlay district and implications in this

area.

The Planning Advisory Commission (PAC) considered this text amendment at their

meeting on March 19, 2014. The PAC recommended approval.



The Planning Department recommends approval.
