AN ORDINANCE

An Ordinance amending the Zoning Atlas of the Consolidated Government of
Columbus, Georgia; this amendment changes certain boundaries of a district
located at 6700 Whitesville Road and 1725 Whittlesey Road from RMF2
(Residential Multi-Family 2) and LMI (Light Manufacturing / Industrial)
Districts to GC (General Commercial) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Department be, and the same is
hereby amended by changing the following described property from RMF2
(Residential Multi-Family 2) and LMI (Light Manufacturing / Industrial)
Districts to GC (General Commercial) District:
All that lot, tract or parcel of land situate, lying and being in Land Lots 58,
63 and 64 of the 8th District of Muscogee County, Georgia, and being more
particularly described as follows:
BEGINNING at an iron pin situated on the dividing line between Land Lots 62 and
63 of the 8th District of Muscogee County, Georgia, said pin being North 88
degrees 07 minutes East 0.4 feet from the intersection of the dividing line
between Land Lots 62 and 63 of the 8th District of Muscogee County, Georgia,
with the eastern line of the right-of-way of the Whites?ville Road, running
thence North 88 degrees 07 minutes East 863.5 feet to an iron pin; running
thence South 0 degrees 57 minutes East 928.7 feet to an iron pin; running
thence North 89 degrees 21 minutes East 663.5 feet to an iron; running thence
South 1 degree 5 minutes East a distance of 2,041.1 feet to an iron; thence
continuing South 1 degree 5 minutes East a distance of 27.6 feet to the South
line of Land Lot 58; thence running South 87 degrees 40 minutes West along the
South line of Land Lot 58 a distance of 667 feet to an iron; running thence
South 1 degree 56 minutes East 734.2 feet to an iron pin situated on the east
line of the right-of-way of Whitesville Road; running thence North 12 degrees
46 minutes West along the east line of the Whitesville Road 84.6 feet to a
point; running thence in a generally northerly direction along the east line of
the Whitesville Road a distance of 658.85 feet to a point in the east right of
way line of the said Whitesville Road; running thence North 10 degrees 34
minutes West 783.8 feet to a point on the east right of way line of the said
Whitesville Road; running thence in a generally northwesterly direction along
the east line of the right of way of the Whitesville Road a distance of 688.46
feet to a point in said right of way; running thence North 14 degrees 00
minutes West 873.8 feet to a point in the east line of the Whitesville Road;
running thence in a generally northwesterly direction along the curve formed by
the east line of the Whitesville Road a distance of 421 feet to a point in the
east line of the said right of way; running thence North 26 degrees 26 minutes
West a distance of 315.5 feet to a point situated on the east line of the right
of way of the Whitesville Road, which point is formed by the inter?section of
the east line of Whitesvil1e Road with the dividing line between Land Lots 62
and 63 of the 8th District of Muscogee County, Georgia; running thence North 88
degrees 07 minutes East .4 feet to the point of beginning.
The above described property is designated as Parcels A and B on a map or plat
made by G. V. Carr & Co., dated October 18, 1954, and duly recorded in the
Office of the Clerk of Superior Court of Muscogee County, Georgia, in Plat Book
11, Page 150.
SAVE AND EXCEPTED from the afore described property, designated as Tract Two
above, are the following conveyances, to-wit:
(1) Warranty Deed from J. Rupert McCardle to Mrs. Martha Brooks King, as
Trustee for Martha Matilda King, A Minor, Under a Deed of Trust dated June 6,
1945, between Ralph 1. King, as Donor, and Mrs. Martha B. King, as Trustee,
which latter Warranty Deed was dated April 30, 1959, and duly recorded in the
Office of the aforesaid Clerk in Deed Book 699, Page 538.
(2) Right-Of-Way Deed from J. R. McCardle to Muscogee County, Georgia, dated
June 6, 1961, and duly recorded in the Office of the aforesaid Clerk in Deed
Book .796, Page 217.
(3) Warranty Deed from J. Rupert McCardle to W. M. Crawford, Inc., dated
December 30, 1971, and duly recorded in the Office of the aforesaid Clerk in
Deed Book 1371, Page 579.
(4) Right-Of-Way Deed Department of Transportation from J. Rupert McCardle to
the dated November 10, 1975, and duly recorded in the Office of the aforesaid
Clerk in Deed Book 1571, Page 466.
(5) Right-Of-Way Deed from J. Rupert McCardle to the Department of
Transportation, dated October 9, 1980, and duly recorded in the Office of the
aforesaid Clerk in Deed Book 1970, Page 319.
(6) Right-Of-Way Deed from J. Rupert McCardle to the Department of
Transportation, dated October 9, 1980, and duly recorded in the Office of the
aforesaid Clerk in Deed Book 1970, Page 316.
(7) Deed of Gift of a one-twelfth (1/12) undivided interest in and to the above
described property, save and except for such prior conveyances aforecited, from
J. Rupert McCardle to T. Michael McCardle, dated August 31, 1984, and duly
recorded in the Office of the aforesaid Clerk in Deed Book 2364, Page 184.
(8) Deed of Gift of a one-twelfth (1/12) undivided interest in and to the above
described property, save and except for such prior conveyances aforecited, from
J. Rupert McCardle to R. Stokley McCardle, dated August 31, 1984, and duly
recorded in the Office of the aforesaid Clerk in Deed Book 2364, Page 186.
(9) Deed of Gift of a one-twelfth (1/12) undivided interest in and to the above
describe property, save and except for such prior conveyances aforecited, from
J. Rupert McCardle to T. Michael McCardle, dated February 12, 1985, and duly
recorded in the Office of the aforesaid Clerk in Deed Book 2418, Page 275.
(10) Deed of Gift of a one-twelfth (1/12) undivided interest in and to the
above described property, save and except for such prior conveyances
aforecited, from J. Rupert McCardle to R. Stokley McCardle, dated February 12,
1985, and duly recorded in the Office of the aforesaid Clerk in Deed Book 2418,
Page 277.
(11) Right-Of-Way Deed from J. Rupert McCardle, acting by and through his
attorneys-in-fact, SARAH J. McCARDLE and R. STOKLEY McCARDLE, and also R.
STOKLEY McCARDLE and T. MICHAEL McCARDLE, individually, to COLUMBUS, GEORGIA,
dated August 11,
1986, and duly recorded in the Office of the aforesaid Clerk in Deed Book 2649,
Page 36.
(12) Right-Of-Way Deed from J. Rupert McCardle, acting by and through his
attorneys-in-fact, SARAH J. McCARDLE and R. STOKLEY McCARDLE to COLUMBUS,
GEORGIA, dated August 11, 1986, and duly recorded in the Office of the
aforesaid Clerk in Deed Book 2649, Page 32.
(13) Warranty Deed from J. Rupert McCardle, by SARAH J. McCARDLE, his duly
constituted attorney-in-fact, to Colonial Lines, Inc., dated October 1, 1986,
and duly recorded in the Office of the aforesaid Clerk in Deed Book 2678, Page
133.
The above-described property is being rezoned with the following condition:
The developer shall pay for traffic signalization at the proposed road that
will intersect with Whitesville Road, subject to city approval of said
signalization.
