An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 1510, 1506, 1426 and 1410 6th Avenue from LMI (Light Manufacturing

Industrial) / UPT (Uptown) with Conditions Zoning District to UPT (Uptown) with

Amended Conditions Zoning District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department be, and the

same is hereby amended by changing the aforementioned properties from LMI

(Light Manufacturing Industrial) / UPT (Uptown) with Conditions Zoning District

to UPT (Uptown) with Amended Conditions Zoning District:



Parcel One ?Parcel 101" - 1510 6th Avenue ? Tax Parcel ID Number #017-017-002



All that tract or parcel of land lying and being in the City of Columbus,

Muscogee County, Georgia being more particularly described as follows:



BEGIN at an iron stake at the intersection of the east line of Sixth (6th)

Avenue and the north line of Fourteenth (14th) Street; going thence south 87

degrees 45 minutes 02 seconds west along a projection of the north line of

Fourteenth (14th) Street a distance of 24.85 feet to an iron stake; go thence

north 02 degrees 48 minutes 30 seconds west 597.20 feet to an iron stake on a

projection of the south line of Fifteenth (15th) Street; go thence north 87

degrees 19 minutes 06 seconds east along said projection of the south line of

Fifteenth (15th) Street 22.91 feet to an iron stake on the east line of Sixth

(6th) Avenue; go thence north 02 degrees 56 minutes 41 seconds west a distance

of 56.84 feet to a point; go thence north 86 degrees 56 minutes 00 seconds east

a distance of 278.50 feet to a point; go thence southerly along an arc of a

curve to the right (radius - 1475.68 feet) an arc distance of 200.14 feet

along a chord bearing south 22 degrees 43 minute 40 seconds east a chord

distance of 200.00. feet to a point; go thence south 86 degrees 56 minutes 00

Georgia, and being known as parcel 101 as shown on a plat recorded in plat book

162 page 59, in the office of the Clerk of Superior Court of Muscogee County,

Georgia, said plat entitled "Replat of Block "13" and Part of Blocks "12" &

"20", Commons and Adjacent Tracts and dated March 3, 2009, being more

particularly described as follows:



Commencing at a drill hole in concrete paving at the intersection of the South

right-of-way line of Linwood Boulevard with the East right-of-way line of 6th

Avenue; thence run South 02 degrees 56 minutes 41 seconds East along the East

right-of-way line of 6th Avenue, a distance of 411.12 feet to an iron pin at

the point of beginning; from said point of beginning, thence run North 86

degrees 56 minutes 00 seconds East, a distance of 278.50 feet to an iron pin on

the West right-of-way line of Norfolk Southern Railroad; thence run in a

Southeasterly direction along the West right-of-way line of Norfolk Southern

All those tracts or parcels of land lying and being in the City of Columbus,

County of Muscogee, State of Georgia and being more particularly known as

Parcels 102 and 103 as shown on a plat recorded in plat book 162 page 59 in the

office of the Clerk of Superior Court of Muscogee County, Georgia, said plat

entitled "Replat of Block "13" and Part of Blocks "12" and "20", commons and

adjacent tracts and dated March 3rd, 2009.



The above-described property is being rezoned subject to the following

condition:



1. The developer shall comply with the site plan for "Swift Mill Redevelopment

Project" drawn by Gullatte Associates, Inc., dated May 17, 2010 and said site

plan is hereby incorporated by reference.

2. The developer shall install and maintain an eight-foot high privacy fence

and adjacent landscaping to include shrubbery as specified by the City Arborist.

3. The developer shall include a noise disclosure statement concerning the

adjacent railyard in each lease or deed to any of the property subject to

rezoning. Said noise disclosure statements shall be filed by the developer or

any owner in the records of the Clerk of the Muscogee County Superior Court

along with any lease or deeds of record related to the property subject to

rezoning. A sample noise disclosure statement is attached to this ordinance.

meeting of said Council held on the day of

members of said Council.
