A RESOLUTION AMENDING RESOLUTION NO. 471-06, AUTHORIZING THE CITY
MANAGER TO ENTER INTO A JOINT PURCHASE AGREEMENT WITH WOODMONT PROPERTIES, LLC,
AN ADJACENT PROPERTY OWNER FOR THE ACQUISITION OF 3601 GINGER DRIVE AKA TAX MAP
072 009 001, CONTAINING 12.874 ACRES +/- FOR A TOTAL JOINT PURCHASE PRICE OF
$600,000.00; TO ALLOW THE CITY TO COMPLETE A DRAINAGE PROJECT ON EFFINGHAM WAY
AND GINGER DRIVE IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA; AUTHORIZING THE
CONVEYANCE OF +/- 2.5 ACRES TO WOODMONT, AND FOR OTHER PURPOSES.
WHEREAS, a portion of Ginger Drive (adjacent to Effingham Way) has been washed
away and is a danger to the citizens of Columbus, and;
WHEREAS, the adjacent property owner, Woodmont Properties, LLC, has
committed to pay $250,000.00 of the joint purchase price ($600,000.00) in
exchange for certain property (+/- 2.5 Acres) after the completion of the
project, as shown on the attached plat, and;
WHEREAS, the joint purchase agreement is contingent upon said property being
rezoned RMF2 for apartments, and;
WHEREAS, Woodmont will pay $250,000.00 and the City will pay $350,000 (paid
from the Real Estate CIP account) for a total joint purchase price of
$600,000.00, and;
WHEREAS, it is in the best interests of the City to purchase the property for
the completion of this project.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
Resolution No. 471-06 is hereby amended and the City Manager is hereby
authorized to:
1. Enter into a joint purchase agreement with an adjacent property owner,
Woodmont Properties, LLC allowing the City to complete a drainage project on
Effingham Way and Ginger Drive aka tax map 072 009 001; and,
2. Accept payment in the amount $250,000.00 from Woodmont Properties, LLC, the
adjacent property owner for the purchase of certain property (+/- 2.5 acres)
remaining from the 12.874 acres +/- after completion of the project as shown on
the attached plat, which plat is incorporated herein by reference. Said
property will be transferred by Quit Claim Deed from the City to Woodmont
Properties, LLC, within 30 days of completion of the Effingham Project; and,
3. Woodmont will initiate the rezoning of certain property (+/- 2.5 acres)
purchased by Woodmont to RMF2, with the remaining acreage to become a
City-owned natural area; and
4. Render payment of $350,000.00 of the purchase price from the Real Estate CIP
account toward the joint purchase price.
5. The development of the +/- 2.5 acres transferred to Woodmont upon
completion of the City?s project shall be limited to the following:
(a) The construction of one apartment building with a maximum of 24 units.
The building will be located in the area outlined in red on the attached site
plan.
(b) The development of a passive park in the two areas identified on the
attached site plan in violet.
(c) Permanent access to the apartment building constructed on the property
will be from within the Greystone Apartment complex.
(d) Temporary access from Effingham Way will only be utilized for
construction until such time permanent access can be constructed from the
Greystone Apartment complex. The existing driveway from Effingham Way will
then be removed by the developer.
(e) These or other conditions shall be addressed at time of rezoning.

9th day of January, 2007, and adopted at said meeting by the affirmative vote
