SUBJECT: Transfer of Property to Muscogee County School District
616 & 628 Veterans Parkway

Recommendation: Approval is requested for the transfer of 0.737 +/- acres of
City property adjacent to the Mildred Terry Library at 616 and 628 Veterans
Parkway a/k/a 020 002 001 & 019 032 006 to the Muscogee County School District.
Background: Per Resolution 121-07 and as amended by Resolution 287-07, the
City of Columbus and the Muscogee County School District entered into a
Memorandum of Understanding (MOU) to exchange property upon the completion of
the Library Project. The MOU calls for an exchange of City own property
adjacent to the Mildred Terry Library and the Firestone site for six acres of
property owned by the School District.
The Muscogee County Library Board has a funding opportunity for the
construction of the new Mildred Terry Library. As a requirement of the
funding opportunity, the ownership of the property is required prior to
December 31, 2007.
Analysis: In order for the Library Board to take advantage of the funding
opportunity, the City will need to transfer the City owned property adjacent to
the Mildred Terry Library to the School District prior to December 15, 2007 and
the full completion of the terms of the MOU. However, the City of Columbus and
the Muscogee County School District remain committed to the remaining exchange
of property according to the terms and conditions of the MOU as outlined in
Resolution 121-07 and as amended by Resolution 287-07.
Financial Considerations: The City will transfer the property to the Muscogee
County School District by Quit Claim Deed and pay all legal expenses.
Legal Considerations: Council must approve the transfer of property in
accordance with Columbus Charter.
Recommendations: Approve the attached resolution authorizing the transfer of
0.737 +/- acres of City property adjacent to the Mildred Terry Library at 616
and 628 Veterans Parkway a/k/a 020 002 001 & 019 032 006 to the Muscogee County
School District.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO TRANSFER 0.737 +/- ACRES
OF CITY PROPERTY ADJACENT TO THE MILDRED TERRY LIBRARY AT 616 AND 628 VETERANS
PARKWAY A/K/A 020 002 001 & 019 032 006 TO THE MUSCOGEE COUNTY SCHOOL DISTRICT.
WHEREAS, the City of Columbus and the Muscogee County School District entered
into a Memorandum of Understanding (MOU) to exchange properties upon completion
of the Library Project; and,
WHEREAS, the Muscogee County School District has agreed to convey six (6) acres
of clean, suitable land to Columbus, Georgia for governmental purposes
including a city service center and recreational uses in exchange for property
known as the Firestone site and property owned by Columbus adjacent to the
Mildred Terry Library; and,
WHEREAS, the Muscogee County Library Board has a funding opportunity for the
construction of the new Mildred Terry Library that requires the ownership of
the City owned property adjacent to the Mildred Terry Library prior to December
15, 2007; and,
WHEREAS, in order to take advantage of this funding opportunity, it is
necessary for the City to transfer the City owned property adjacent to the
Mildred Terry Library prior to December 15, 2007 and the full completion of MOU
outlined in Resolution 121-07; and,
WHEREAS, the City of Columbus and the Muscogee County School District remain
committed to complete the remaining exchange of property according to the terms
and conditions of the MOU outlined in Resolution 121-07 and as amended by
Resolution 287-07 after January 1, 2008.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to transfer 0.737 +/- acres of City
property adjacent to the Mildred Terry Library at 616 and 628 Veterans Parkway
a/k/a 020 002 001 & 019 032 006 to the Muscogee County School District.
Introduced at a regular meeting of the Council of Columbus, Georgia, held the
_________day of _____________, and adopted at said meeting by the affirmative
vote of ____________members of said Council.
