SUBJECT: Sidewalk Variance for 4306 15th Avenue



INITIATED BY: Department of Engineering





Recommendation: Approval is requested authorizing a variance to City

Code Section 7.10.1 delaying the construction of sidewalk along the right of

way frontage at 4306 15th Avenue until sidewalks are installed on adjacent

properties.



Background: McCown Hall Properties, LLC is developing commercial

property at 4306 15th Avenue. The project will include an office building and

warehouse. There are currently no sidewalks in the area.



Analysis: The developer of the project has requested delay in the

installation of the sidewalk until such time sidewalk is added to the adjoining

properties. In addition, there are existing trees that would have to be

removed in order to construct new sidewalk.



Financial Considerations: There are no financial impacts to the City.



Projected Annual Fiscal Impact Statement: Public Works would be required to

maintain sidewalk if they were required and constructed.



Legal Considerations: A variance to City Codes involving public right-of-way

requirements must have Council approval.

A RESOLUTION

A RESOLUTION AUTHORIZING A VARIANCE TO THE CITY SECTION 7.10.1 DELAYING THE

REQUIREMENT FOR SIDEWALK CONSTRUCTION ALONG THE RIGHT OF WAY FRONTAGE AT 4306

15TH AVENUE UNTIL SIDEWALK IS CONSTRUCTED ON ADJOINING PROPERTIES.

WHEREAS, construction plans have been submitted for an office building and

warehouse at the aforementioned property; and,

WHEREAS, the developers of the property has requested a variance to City Code

Section 7.10.1 which requires the construction of a 5 ft sidewalk as part of

new construction; and,

WHEREAS, there are existing trees within the right of way that would have to be

removed in order to construct the sidewalk.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That a variance be granted to City Code Section 7.10.1 for the construction of

sidewalks at 4306 15th Avenue, to allow the installation of sidewalks for this

development be postponed until additional sidewalks are constructed on

adjoining properties as specified by the City Engineer. This variance is

granted on the condition that the property owner or its successors shall convey

by deed or easement sufficient property for sidewalk purposes and shall pay for

such improvements.
