SUBJECT: Falcon Street-Closure and Abandonment



INITIATED BY: Department of Engineering





Recommendation: Approval is requested to authorize the changing of the

Official Street Map and Tax Maps of the Consolidated Government of Columbus,

Georgia by officially closing and abandoning Falcon Street beginning at its

intersection of the official right of way of Fairchild Drive and extending

eastward 128 ft. more or less to the dead end as shown on the Plat for Section

Five, Lincoln Hills Subdivision; reserving utility easements; and for other

purposes.



Background: The Department of Community Reinvestment received a request from

Alice Gibson, 5622 Fairchild Drive, to obtain the ownership of Falcon

Street. The right of way was platted 1956 and recorded in 1959 as part of

the development of Section 5, Lincoln Hills Subdivision. The road is currently

used for access to the driveway for 5622 Fairchild Drive. No other driveways

exist on this short section of road. The adjoining property owner has

provided a statement that he has no interest in the road. Staff was unable to

determine if the road was officially accepted by the County/City.



Analysis: Staff has no objections to the official closure and abandonment of

the road.



Financial Considerations: The property owner will be responsible for any

disposition expenses.



Projected Annual Fiscal Impact Statement: The City would no longer be

responsible for maintenance of the road.



Legal Considerations: Council approval is required to close and abandon

public streets.



Recommendations/ Actions: Approval is requested to authorize the changing of

A RESOLUTION

NO. _____

A RESOLUTION AUTHORIZING THE CHANGING OF THE OFFICIAL STREET MAP AND TAX MAP OF

THE CONSOLIDATED GOVERNMENT OF COLUMBUS, GEORGIA BY OFFICIALLY CLOSING AND

ABANDONING FALCON STREET ; BEGINNING AT ITS INTERSECTION WITH FAIRCHILD DRIVE

AND EXTENDING EASTWARD A DISTANCE OF 128 FT. MORE OR LESS AS SHOWN ON THE PLAT

FOR SECTION 5, LINCOLN HILLS SUBDIVISION; AUTHORIZING THE DISPOSAL OF THE SAID

RIGHT OF WAY IN ACCORDANCE WITH APPLICABLE STATE LAW; RESERVING UTILITY

EASEMENTS; AND FOR OTHER PURPOSES.

WHEREAS, Falcon Street was platted as a public street as part of Section 5,

Lincoln Hills Subdivision in 1956; and,

WHEREAS, the road was never extended and has not been used by the public and

primarily serves the residence at 5622 Fairchild Drive; and,

WHEREAS, the Department of Engineering has determined this street segment is

not critical to traffic flow in the area.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

SECTION I.

The "Official Street Map , Consolidated Government of Columbus, Georgia"

maintained in accordance with Section 18.1 of the Columbus Code and appropriate

Tax Map are hereby amended by deleting the following property from said maps:

"All that portion of Falcon Street, as shown on a plat for Section 5,

Lincoln Hills dated October 5, 1956 prepared by Aldridge, Moon Russell & King

and recorded in Plat Book 21 Folio 65.

Together with and subject to covenants, easements, and restrictions of record.

Said tract or parcel containing 0.177acres, more or less."

SECTION II.

That the Council finds that the segment of right of way described in Section I.

above no longer serves a substantial public purpose. This abandonment is hereby

declared to be in the best public interest. Accordingly, said segment is

hereby declared abandoned and removed from the Official Street Map of Columbus,

Georgia in accordance with O.C.G.A. Section 32-7-2(c) . The City Manager is

authorized to transfer the property to the adjacent property owner in

accordance with the provisions of O.C.G.A. Section 32-7-4 if determined its

necessary and in the best interest of the Consolidated Government of Columbus,

Georgia.

SECTION III.

All existing utility easements in the Street Segment shall be reserved.
