A RESOLUTION AUTHORIZING PROPERTY BEING DECLARED AS SURPLUS AND THE TRANSFER BY

QUIT CLAIM DEED 7,500 SQUARE FEET +/- OF CITY PROPERTY TO THE OWNER OF 4753

GARDINER DRIVE IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA .

WHEREAS, there is no direct access to the creek behind Gardiner Drive; and,

WHEREAS, the owner has snakes, rodents and the like entering the property from

the creek; and,

WHEREAS, the owner will pay for a survey of the property prior to transfer;

and,

WHEREAS, the property is being declared surplus, transferred, and quit claimed

pursuant to 7-501 of the Columbus Charter because it is no longer needed by the

consolidated government. This property is also land locked and creating a

nuisance to the property at 4753 Gardiner Drive.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to:

1. Declare the above subject property as surplus and transfer same to the

owner of 4753 Gardiner Drive.

2. Execute a Quit Claim Deed for said property and include a provision

restricting the cutting of trees within 25' of the top of the bank of the

creek.
