SUBJECT: Sidewalk Variance for 1619 Bradley Park Drive
INITIATED BY: Department of Engineering
Recommendation: The staff does not recommend a delay in sidewalk installation
but if Council desires, approve the attached Resolution authorizing a variance
to City Code Section 7.10.1 for the development at 1619 Bradley Park Drive to
allow the sidewalk construction be delayed until adjoining properties are
developed or within a two year period, whichever occur
Background: Pezold Management Associates, Inc. is constructing a new
McDonald's facility at 1619 Bradley Park Drive. This new development was
reviewed by the Engineering Department with plans approved that included a five
(5') concrete sidewalk along the north side of Bradley Park Drive and east
side of Whittlesey Road across the public street frontage a private easement
in accordance with City Code Section 7.10.1. Pezold Management Associates,
Inc. has submitted a letter dated February 17, 2014 to delay the installation
to a future date at which time the building should be operational and receiving
income.
Analysis: City Code Section 7.10.1 was approved as part of the adoption of the
UDO in response to request by citizens for additional sidewalk throughout the
community. This Code requires that all new residential, commercial and
industrial development or redevelopment provide sidewalks along the City's
right of way as part of the construction. The City includes sidewalks on all
major roadway projects and under an annual contract. The City is also in the
final stages of adopting and implementing an Alternative Transportation Plan as
well as Complete Streets Program. Sidewalks are key elements of both of these
programs.
Financial Considerations: There are no financial impacts to the City.
Projected Annual Fiscal Impact Statement: The Department of Public Works would
be responsible for maintenance of the sidewalk after the initial installation
as part of the normal operating budget.
Legal Considerations: A variance to City codes involving public right of way
requirements must have Council approval.
Recommendations/ Actions: The staff does not recommend a delay in sidewalk
installation but if Council desires, approve the attached Resolution

Bradley Park Drive to allow the sidewalk construction be delayed until
adjoining properties are developed or within a two year period, whichever

A RESOLUTION AUTHORIZING A VARIANCE TO THE CITY SECTION 7.10.1 FOR THE
MCDONALDS' DEVELOPMENT AT 1619 BRADLEY PARK DRIVE, PEZOLD MANAGEMENT
ASSOCIATES, INC. ; ALLOWING THE SIDEWALK CONSTRUCTION TO BE POSTPONED UNTIL
SIDEWALK IS INSTALLED ON ADJACENT PROPERTIES OR FOR A PERIOD OF TWO YEARS
WHICHEVER COMES FIRST.
WHEREAS, construction plans were approved for the construction of the afore
mentioned retail center that included the construction of a five (5') concrete
sidewalk in accordance to City Code Section 7.10.1 along the north side of
Bradley Park Drive and east side of Whittlesey Road for the length of the
property; and,
WHEREAS, there are no other sidewalks on the north side of Bradley Park Drive
and east side of Whittlesey Road due to the property being developed prior to
the requirement for installation of sidewalk as part of development; and,
WHEREAS, the postponing the construction of the sidewalk until other sidewalk
in the area is installed and pedestrian traffic develops or a period of two (2)
years from the adoption of this resolution, whichever comes first reduces the
initial financial impact; and,
WHEREAS, the owner shall receive written notification from the Director of
Engineering when the conditions described herein trigger the need for the
installation of the five (5') concrete sidewalk across the frontage of 1619
Bradley Park Drive; and,
WHEREAS, the owners reserve the right to request an extension in time from
Council should the need for the sidewalk fail to develop within the two (2)
year period.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That a variance be granted to City Code Section 7.10.1 for the
construction of sidewalks to allow the installation of sidewalks for this
development to be postponed until the development of the sidewalks in area or
for a period of two years whichever occurs first.
