SUBJECT: Advertising Sign - Right-of-way Encroachment, 5592 Whitesville

Road

Recommendation: Approval is requested to authorize a variance to City Code

Section 4.4.8 Signs in Public Right-of-Way to allow The Landings advertising

sign located near the north property line of 5592 Whitesville Road to encroach

2.4 feet into the Public Right-of-Way.



Background: The Landings Development located at 5592 Whitesville Road has an

existing advertising sign located about 37 feet south of their north property

line. This sign overhangs the Whitesville Road Right-of-Way about 2.4 feet

being in place for several years. The Landings desire to upgrade this sign

from a static panel sign to a digital screen display with wording and/or

graphics.



Analysis: Both the Engineering and the Inspection and Codes departments

examined the sign encroachment request not finding any conflicts at this time.

It is our recommendation to approve the encroachment request with the condition

that should the sign become in conflict with any future public improvement, the

owner will remove it without any cost to the City.



Financial Considerations: The City does not incur any expenses.



Projected Annual Fiscal Impact Statement: This action will not cause any

future fiscal impacts to the City.



Legal Considerations: Variances to the City Code require Council approval.



Recommendations/ Actions: Approve the recommended variance.





















A RESOLUTION

A RESOLUTION AUTHORIZING A VARIANCE TO CITY CODE SECTION 4.4.8 SIGNS IN THE

PUBLIC RIGHT-OF-WAY TO ALLOW AN EXISTING ADVERTISING SIGN LOCATED AT 5592

WHITESVILLE ROAD FOR THE LANDINGS DEVELOPMENT TO PERMANENTLY ENCROACH 2.4 FEET

INTO THE RIGHT-OF-WAY; WITH THE CONDITION THAT SHOULD THIS SIGN BECOME A

CONFLICT WITH ANY FUTURE PUBLIC IMPROVEMENT, THE OWNER WILL REMOVE IT WITHOUT

ANY COST TO THE CITY.

WHEREAS, there exists an advertising sign located at 5592 Whitesville Road for

The Landings development that is about 37 feet south of their north property

line and overhangs City Right-of-Way; and,

WHEREAS, the Landings desires to upgrade this advertising sign from a static

panel display to digital screen display having dimensions of approximately

70?x95?; and,

WHEREAS, the existing sign overhangs City Right-of-Way by 2.4 feet in violation

of City Code Section 4.48 Signs in the Public Right-of-Way which is prohibited;

and,



WHEREAS, the Landings advertising sign has encroached for several years

without any conflicts; and,



WHEREAS, the Engineering and Inspections and Code Departments examined

this encroachment and are agreeable to allow the encroachment to continue with

the condition that should the sign become in conflict with any future public

improvement, it will be removed at no cost to the City.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That a Variance to City Code Section 4.4.8 signs in the public Right-of-Way is

hereby approved to allow an existing sign located at 5592 Whitesville Road for

the Landings Development to permanently encroach 2.4 feet into the

Right-of-Way; with the condition that should this sign become a conflict with

any future public improvement, the owner will remove it without any cost to the

City.
