Subject: (ZC0201-2) Request to rezone approximately 1.36 total acres of properties

located at 3523, 3529, & 3533 Trinity Drive; & 2114 Box Road



In January 2002, an application was submitted by Schuster Enterprises, Inc. to

rezone the above properties from R-1A (Low Density Residential) District to A-O

(Apartment-Office) District as outlined in the attached report. Eighteen (18)

property owners within 300 feet were notified of the rezoning request. The

Planning Division received comments on this rezoning request. However, no one

offered support or opposition.



The Planning Advisory Commission recommends that the request be conditionally

approved based upon the fact that it is compatible with existing land-uses and

is served by public water and sanitary sewer. The recommended condition is:

all lighting shall be directed internally using deflectors.



The Planning Division recommends conditional approval based on the fact that it

is compatible with existing land-uses. The recommended condition is the same

as that recommended by the Planning Advisory Commission. However, the Planning

Division recommends additional conditions: 1) only two driveway cuts shall be

allowed onto Trinity Drive and 2) the properties shall be used for office use

only.
