Subject: (ZC0209-4) Request to amend Condition #6 of Ordinance 96-116 to allow access to

2nd Avenue



In September 2002, an application was submitted by KeeMed Enterprises, Inc. to

amend Ordinance 96-116 as

outlined in the attached report. Thirty-three (33) property owners within 300

feet were notified of the rezoning

request. The Planning Division did not receive any comments concerning this

rezoning request.



The Planning Advisory Commission recommends approval of the request to amend

Condition #6 of ordinance 96-116 to read as follows: Access shall be limited to

2nd Avenue.



The Planning Division concurs with the recommendation of the Planning Advisory

Commission based upon the report submitted by Traffic Engineering, which

states: Ordinance No. 96-116 was drafted to prohibit access to 42nd Street.

This ordinance should have granted access to 2nd Avenue. The Georgia

Department of Transportation and the CCG Department of Engineering issued

permits to Sandman Waste Services, Inc. in May 1997; inspected and approved the

work on 2nd Avenue. Therefore, the Traffic Engineering Division recommends

that access to the property be granted from 2nd Avenue. The permit is on file

in the Traffic Engineering records.
