A Resolution Authorizing THE CITY MANAGER TRANSFER THE CITY'S "ONLY" COMMERCIALLY OWNED DETENTION POND
AT FOUNTAIN COURT NEAR WILLIAMS ROAD A/K/A 191 011-080 AND ACCEPT THE DOUBLE
TREE SUBDIVISION DETENTION POND AT THE END OF FOUNTAIN COURT IN COLUMBUS,
MUSCOGEE COUNTY, GEORGIA. whereas, Pete Hart owned the commercial detention pond at Fountain Court; and,
WHEREAS, the detention pond at Fountain Court was accepted and deeded to the
City in 1997 and is the only "Commercially" owned City detention pond; and,
whereas, the owned of Fountain Court, addressed the issues brought forth by Public
Service's; and,
WHEREAS, the owners of Doubletree Subdivisions are willing to deed the
detention pond to the City; and,
WHEREAS, the Double Tree Subdivision is using an old lake-bed as a detention
pond; and,
WHEREAS, "Doubletree Subdivision" Pond will be transfer to the City.
That the City Manager is hereby authorized to:
1. Declare as surplus the Fountain Court Detention Pond, a commercial detention
facility,
2. Transfer said detention facility to Pete Hart,
3. Accept the "Doubletree Subdivision" Pond currently owned by Dykes
Development Company as in Plat Book 132 Page 29 (Section Two Doubletree), to be
accepted by the City in exchange for "Fountain Court" Pond in Columbus,
Muscogee County, Georgia; and,
4. File all deeds and associated documents with the Clerk of Superior Court for
permanent record.
