A Resolution Authorizing CONSENT TO COLUMBUS, GEORGIA'S CONDEMNATION OF PART OF LAND LOTS 55 AND 56 OF

THE 7TH DISTRICT OF COLUMBUS, MUSCOGEE COUNTY, GEORGIA, CONTAINING 99.92 ACRES

OF LAND, A/K/A TAX MAP IDENTIFICATION NO. 060-001-003 whereas, it is necessary for public uses and purposes that Columbus, Georgia acquire and

be vested with the fee simple title, state, or interest in the following

described property and/or property interests therein, to-wit:



All that certain tract or parcel of land containing 99.92 acres, more or less,

lying in Land Lot Nos. 55 and 56 of the 7th District of Muscogee County,

Georgia, and being a part of the land purchased by Wilson M. Camp from John

William Cooper, by Deed dated June 1, 1961 of record in the Office of the Clerk

of Muscogee Superior Court in Deed Book 795, Folio 519, and being all of the

property purchased on said date which lies in said Land Lots 55 and 56 of said

District. The property hereby conveyed is bounded on the south by the line

dividing Land Lot 55 from Land Lot 59 and Land Lot 56 from Land Lot 58 of said

District; on the west by the Chattahoochee River; on the north by land now or

formerly owned by Woolfolk; and on the east by lands now or formerly owned by

Bickerstaff Brick Company. The property hereby conveyed is a part of the

property shown on a plat made by Hugh McMath on November 1, 1928, of record in

said Clerk?s Office in Plat Book 6, Page 155, which contains distances and

bearings between certain stones and other points marking a part of the boundary

lines of the property hereby conveyed, and the line between said Land Lots 55

and 56 and 59 and 58, respectively, being the southern boundary of the property

hereby conveyed.



The above described property is the identical property conveyed by Wilson M.

Camp to Camp Concrete Industries, Inc. by Deed dated July 24, 1981, and of

record in said Clerk?s Office.



Said conveyance is made subject to all easements, covenants, and restrictions

of record; also subject to easement rights of the United States of America

acquired under condemnation proceedings filed in the Office of the Clerk of the

United States District Court of the Middle District of Georgia, Columbus

Division, in Civil Actions Numbered 956 and 986.



--together with and including all rights, members and appurtenances belonging

or in any manner appertaining to said lands (including without limitation any

rights and easements appurtenant to said lands that extend beyond the

boundaries thereof into adjacent or surrounding properties), all improvements,

trees and shrubbery thereon.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

1.

That there is a necessity of acquisition of said property and/or

property interests therein under the provisions of the Official Code of Georgia

Annotated ?22-2-100, et. seq

2.

That the City Manager of Columbus, Georgia be, and he hereby is,

authorized to issue such orders and file such papers in the courts and enter

into such agreements as he deems necessary for the acquisition of said property

and/or property interests therein, by condemnation under the provisions of said

Act, or otherwise.

3.

That acquisition of such property and/or property interests therein is

needed for public uses and purposes.

4.

That the Mayor, City Manager, and City Attorney, or their

representatives, are hereby authorized to take any and all lawful action that

they deem needful, necessary, advisable, or proper for acquisition of said

property and/or property interests therein pursuant to and in accordance with

the provisions of the Official Code of Georgia Annotated ?22-2-100 et. seq., or

otherwise.

5.

That it is desirable to have a judicial ascertainment and judicial

supervision of all questions and proceedings connected with the condemnation of

said property and/or property interests therein and the determination of the

just and adequate compensation to be paid to the condemnees for the acquisition

thereof.

6.

That Columbus, Georgia, through its properly constituted officers and

representatives, is willing to pay the true owners and persons having an

interest therein just and adequate compensation for said property and/or

property interests therein sought to be condemned and all damages to which the

respective owners are legally entitled.
