A Resolution Authorizing THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING (MOU) WITH

EAGLE AND PHENIX, JOINT VENTURES LLC AND FLOURNOY CONSTRUCTION COMPANY FOR THE

CONSTRUCTION OF THE RIVERWALK FROM THE RIVER CLUB TO THE 13TH STREET BRIDGE FOR

A SUM NOT TO EXCEED $3.4 MILLION DOLLARS whereas, Eagle and Phenix Joint Venture, LLC is in the process of redevelopment of the

Eagle and Phenix site. The redevelopment will consist of a mixed use

property to include residential lofts and condominiums, office buildings,

retail stores and restaurants; and;
whereas, in order to have an efficient construction process it has been determined that

RiverWalk construction and the improvement on the Eagle and Phenix property

should be performed by one firm. The MOU will provide the opportunity to

accomplish this with one firm . The Eagle and Phenix Joint Ventures, LLC and

Flournoy Construction Company will construct the RiverWalk for a sum not to

exceed $3.4 million dollars and after completion transfer the property to the

City; and;

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is authorized to enter into a MOU with Eagle and Phenix

Joint Venture, LLC and Flournoy Construction Company for the construction of

the Riverwalk from the River Club to 13th Street. for a sum not to exceed $3.4

million dollars.
