A Resolution Authorizing THE CITY MANAGER TO DECLARE THE STREET SEGMENT AND RIGHT-OF-WAY OF BANKERS
BOULEVARD FROM ITS NORTH RIGHT-OF-WAY LINE SOUTH A DISTANCE OF 141 FEET, AS
SHOWN AS PARCEL "C" ON THE ATTACHED DRAWING AS SURPLUS AND QUIT CLAIM SAID
PROPERTY TO TIC CREDIT UNION IN EXCHANGE FOR PARCELS "A" AND "B" ALSO SHOWN ON
THE ATTACHED DRAWING THAT IS MADE PART OF THIS RESOLUTION BY REFERENCE DATED
FEBRUARY 14, 2005 BY FRENCH AND ASSOCIATES, INC. whereas, the TIC Federal Credit Union located at 4411 Bankers Boulevard plans to
reconstruct the existing facility to expand using both the existing lot located
on the west side and the vacant lot located on the east side of Bankers
Boulevard; and,
whereas, TIC Federal Credit Union presented the proposed plans depicting the new
building to located across the existing Bankers Boulevard with parking and
circulation using both the east and west lots, to the City, Peachtree Mall and
other businesses along Banker Boulevard receiving their support; and,
WHEREAS, TIC Federal Credit Union reached a written agreement with Peachtree
Mall to include an interparcel access agreement; and,
WHEREAS, the City supports the new development along with the TIC neighbors
recommending approval of a property transfer to accomplish this development;
and,
WHEREAS, the City agrees to quitclaim parcel "C" of the Bankers Boulevard
street/right-of-way in exchange for parcels "A" and "B" for the purpose of
constructing a permanent cul-de-sac; and,
WHEREAS, the transfer of this street segment provides that all existing utility
easements of record remain in effect and providing appropriate width as
required by applicable utility companies shall be reserved for unknown
utilities.
That the City Manager is hereby authorized to declare street segment
and right-of-way of Bankers Boulevard from its north right-of-way line south a
distance of 141 feet. as shown as parcel "C" on the attached drawing as surplus
and Quit Claim said property to TIC Credit Union in exchange for Parcels "A"
and "B" also shown on attached drawing dated February 14, 2005 by French and
Associates, Inc.
