A Resolution Authorizing THE CITY MANAGER TO AMEND THE LEASE AGREEMENT FOR PROFESSIONAL HOCKEY AT THE
COLUMBUS CIVIC CENTER SECTION 8.1 FOOD AND BEVERAGE AND MERCHANDISE SALES. whereas, current agreement was approved July 30, 2002, by Resolution #448-02;
whereas, DVA Sports, L.L.C. assumed the lease for the performance of professional hockey
at the Columbus Civic Center effective October 1, 2001 under the terms of the
initial lease;
WHEREAS, this Council deems appropriate to amend terms of the DVA Sports,
L.L.C., provision considering with concession and revenue.
That the City Manager is hereby authorized to execute the following
amendment in section 8.1 (a) of the Amended and Restated Agreement made the
30th day of July, 2002 effective October 1, 2001, by and between City of
Columbus, Georgia ("Licensor"), and DVA Sports, L.L.C., a Georgia limited
liability company ("Licensee");
"Licensor shall have sole rights to fifty percent (50%) of any and all
concession and catering revenues generated from any and all Hockey Events.
Licensor will remit to Licensee for each such Hockey Event fifty percent (50%)
of any and all concession and catering revenues received by the Licensor from
its contacted concessionaire(s) and caterers."
