A Resolution Authorizing THE ENGINEERING DEPARTMENT TO ISSUE A PERMIT TO ST. LUKE METHODIST CHURCH FOR
AN ENCROACHMENT INTO THE RIGHT-OF-WAY FOR THE INSTALLATION OF A NEW BUILDING
FACADE ALONG THE WEST SIDE OF 3RD AVENUE FOR AN ENCROACHMENT NOT TO EXCEED FOUR
(4) INCHES AND A NEW BUILDING CORNICE NOT TO EXCEED TWELVE (12) INCHES, FOR THE
RENOVATIONS TO THE EXISTING BUILDING LOCATED AT 1043 - 3RD AVENUE. SAID
ENCROACHMENT INCLUDES THE REQUIREMENT THAT SHOULD THE CITY NEED TO MAKE
IMPROVEMENTS TO THE RIGHT-OF-WAY ANY TIME IN THE FUTURE; THEN, ST. LUKE
METHODIST CHURCH SHALL REMOVE THE CONFLICT AT NO COST TO THE CITY. whereas, St. Luke Methodist Church is in process of renovating the existing building
located at 1043 - 3rd Avenue into a new Middle School; and.
whereas, the East and North Facade of the building does not have a set back aligning
with the City Right-of-Way; and,
WHEREAS, the renovations proposed require the installation of a new facade and
cornice that will encroach into the existing Right-of-Way; and,
WHEREAS, on the East side, the building facade will encroach into the
Right-of-Way not more than four (4) inches and the overhead cornice will not
exceed twelve (12) inches; and,
WHEREAS, the Department of Engineering and the Department of Inspections and
Codes reviewed the request recommending the approval provided that should any
future improvements to Right-of-Way have a conflict with the Right-of-Way
encroachment; then, the encroachment shall be removed by St. Luke Methodist
Church at no expense to the City.
That the Engineering Department is hereby authorized to issue a permit
to St. Luke Methodist Church for an encroachment into the Right-of-Way for the
installation of a new building facade along the West side of 3rd Avenue for an
encroachment not to exceed four (4) inches and a new building cornice not to
exceed twelve (12) inches, for the renovations to the existing building located
at 1043 - 3rd Avenue. Said encroachment includes the requirement that should
the City need to make improvements to the Right-of-way any time in the future;
then, St. Luke Methodist Church shall remove the conflict at no cost to the
City.
