A Resolution Authorizing THE CITY MANAGER TO EXECUTE LEGAL DOCUMENTS BETWEEN THE W.C. BRADLEY COMPANY
AND THE CITY FOR THE PURPOSE OF CLEARING TITLE TO THE FORMER RIGHT-OF-WAY OF
FRONT AVENUE BETWEEN 11TH STREET AND 12TH STREET, BAY AVENUE BETWEEN 11TH
STREET AND 12TH STREET, 11TH STREET AND 12TH STREET WEST OF FRONT AVENUE AND
PARCELS 100, 200, 300 AND 400; ACCEPTING DEED TO THE CITY FROM THE W.C. BRADLEY
COMPANY FOR THE NEWLY RELOCATED BAY AVENUE BETWEEN 11TH STREET AND 12TH STREET
AND ACCEPTING A WARRANTY DEED FOR PARCEL 300 FOR USE AS A PARK AS DEFINED IN
THE REVISED REPLAT OF CITY LOTS 31, 32, 33, 34, PART OF FORMER RIGHTS-OF-WAY OF
BAY AVENUE AND FRONT AVENUE AND PART OF WATER LOTS 20 THROUGH 30 PREPARED BY
MOONS, MEEKS, MASON & VINSON, INC. DATED JUNE 24, 2004. whereas, the City and the W.C. Bradley Company has planned and worked together in the
development and construction of the Riverside Building project; and,
whereas, the Riverside Building project is complete needing to finalize the necessary
legal documents between the City and the W.C. Bradley Company; and,
WHEREAS, the City quitclaims to the W.C. Bradley Company any interest in the
former right-of-way of Front Avenue between 11th Street and 12th Street, Bay
Avenue between 11th Street and 12th Street and in Parcels 100, 200, 300 and
400; and,
WHEREAS, the W.C. Bradley Company quitclaims to the City any interest in 11th
Street and 12th Street west of Front Avenue and Parcel 600; and,
WHEREAS, the W.C. Bradley Company deeds the new relocated Bay Avenue
improvements and right-of-way between 11th Street and 12th Street to the City;
and,
WHEREAS, the W.C. Bradley Company provides a Warranty deed conveying Parcel 300
to the City for use as a park.
That the City Manager is hereby authorized to execute legal documents
between the W.C. Bradley Company and the City for the purpose of clearing title
to the former right-of-way of Front Avenue between 11th Street and 12th Street,
Bay Avenue between 11th Street and 12th Street, 11th Street and 12th Street
west of Front Avenue and parcels 100, 200, 300 and 400; Accepting deed to the
City from the W.C. Bradley Company for the newly relocated Bay Avenue between
11th Street and 12th Street and accepting a warranty deed for parcel 300 for
use as a park as defined in the revised replat of city lots 31, 32, 33, 34 part
of former rights-of-way of Bay Avenue and Front Avenue and part of water lots
20 through 30 prepared by Moons, Meeks, Mason & Vinson, Inc. dated June
24,2004.
