A Resolution Authorizing A SUBDIVISION VARIANCE FOR KAM, INCORPORATED FOR THE ?REPLAT OF LOTS 51, 52,
53, 54, & 55, BLOCK ?B,? OGLETREE WOODS PURSUANT TO COLUMBUS CODE SECTION
18A-53. whereas, Tract ?A? is substandard because it does not conform to the lot frontage
requirement to front for at least twenty-five (25) feet upon a dedicated public
right-of-way (street), as required by the C-2 (Neighborhood Commercial) zoning
district and the Columbus Subdivsion Regulations; and
whereas, Tract ?A? does not meet public street frontage criteria which require a lot
fronting for at least twenty-five (25) feet on a public street, as required by
the Columbus Zoning Ordinance; and
WHEREAS, Mr. Michael Kam wishes to construct a building on Tract ?A;? and
WHEREAS, Mr. Michael Kam has requested a variance citing that the strict
adherernce of the regulation will create an undue hardship; and,
WHEREAS, the Planning Division has reviewed the replat and finds that the
criteria of Columbus Code Section 18A-53 for approval of variances are met, and
the intent of the standard is maintained.
Pursuant to Columbus Code Section 18A-53, the Replat of Lots 51, 52,
53, 54, and 55, Block ?B,? Ogletree Woods, dated May 22, 2003, is approved for
a variance to Tract ?A,? allowing re-subdivision of a parcel and the erection
of a building upon a substandard lot that does not front for at least
twenty-five (25) feet upon a dedicated right-of-way (street).
