A Resolution Authorizing AUTHORIZING A SPECIAL EXCEPTION USE TO EXTEND THE HEIGHT OF AN EXISTING

WIRELESS COMMUNICATION FACILITY FROM 141 FEET TO 199 FEET FOR WIRELESS

COMMUNICATION SERVICES ON PROPERTY LOCATED AT 3650 Buena Vista Road. whereas, Preferred Sites, LLC has appropriately applied for a Special Exception Use to

extend the height of an existing wireless communications tower from 141 to 199

feet.
whereas, transmission towers for communications towers are permitted solely as a Special

Exception Use under the current C-3 (General Commerical) District; and,
WHEREAS, the Planning Division has reviewed the request and finds that the

criteria of Section 22-26.2 for approval of a Special Exception Use have been

properly met except for Section 22.26.2 (E)(3)(b)(2), which regulates minimum

residential setback requirements for wireless communications facilities.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That all the criteria of Section 22-26.2 have been met with the following conditions:



1) The variance request to reduce the minimum residential setback from 300 feet to 210.5 feet is granted;



2) The tower must meet the standard for the minimum residential setback requirements where "a tower must be placed no closer than a distance equal to the height of the tower structure from any residential zoned district or residential structure, whichever is greater in distance;"



3) The tower must be placed at its initial minimum residential setback of 210.5 feet from the nearest residential structure; and



4) The height of the tower shall be 199 feet.



A Special Exception Use to extend the height of the existing wireless communications tower from 141 feet to 199 feet for wireless communication service is granted for the property located at 3650 Buena Vista Road.


Introduced at a regular meeting of the Council of Columbus, Georgia, held the ________ day of __________ and adopted at said meeting by the affirmative vote of  ____________ members of said Council.
