A Resolution Authorizing THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED TO ISAIAH HUGLEY, SR. AND CAROLYN
F. HUGLEY IN EXCHANGE FOR PROPERTY NEEDED FOR THE ST. MARY'S ROAD PROJECT
STP-8038(7). whereas, the St Mary's Road Right of Way Plans indicate a need to acquire right of way
leaving some properties as uneconomic remnants; and,
whereas, as described in the City Charter Sec. 7-501(4), Isaiah Hugley Sr. and Carolyn
F. Hugley, at 3312 St. Mary's Road, being the adjoining property owners (parcel
9) to the uneconomic remainder (parcels 6r), as depicted on the attached right
of way plan and Plat, dated 21, September 2004, titled Right of Way Survey
(parcel 101, 0.226 acres) for Columbus Consolidated Government Part of Land Lot
100, Coweta Reserve, upon request, is entitled to said property and the St
Mary's Road Right of Way Plans indicate a need to acquire right of way leaving
some properties as uneconomic remainder; and,
WHEREAS, said uneconomic remainder serves no useful purpose to the Columbus
Consolidated Government and it is considered to be in the best interest of
Columbus, Georgia to Quit Claim same to Isaiah Hugley Sr. and Carolyn F. Hugley
in exchange for the fair market value of said uneconomic remaining property,
being the difference between the Fair Market Value of the required right of way
of the Hugley property less the Fair Market Value of the remaining property;
and,
WHEREAS, because of the public positions held by Mr. and Mrs Hugley, a
disclosure document will be filed in the Clerk of Council Office.
That the City Manager or his designee is hereby authorized to execute a
Quit Claim Deed of uneconomic remainder to Isaiah Hugley and Carolyn F. Hugley
in exchange for the Fair Market Value of said uneconomic remaining property,
being the difference between the Fair Market Value of the required right of way
of the Hugley property less the Fair Market Value of the remaining property
(parcel 6r) on the St. Mary's Road Project STP-8038-(7).
