A Resolution Authorizing THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED (0.176 AC.) TO BOBBY G. PENNY AND

CONNIE PENNY IN EXCHANGE FOR PROPERTY NEEDED FOR THE ST. MARY'S ROAD PROJECT

STP-8038(7). whereas, the St Mary's Road Right of Way Plans indicate a need to acquire right of way

leaving some properties as uneconomic remnants; and,
whereas, as described in the City Charter Sec. 7-501(4), Bobby G. Penny and Connie Penny

at 110 Brennan Road, being the adjoining property owners (parcel 62) to the

uneconomic remainder (parcels 5r and part of 6r), as depicted on attached right

of way plan and Plat, dated 21, September 2004, titled Right of Way Survey

(parcel 100, 0.176 acres) for Columbus Consolidated Government Part of Land Lot

100, Coweta Reserve, upon request, is entitled to said property; and the St.

Mary's Road Right of Way plans indicate a need to acquire right of way, leaving

some properties as an uneconomic remainder; and,
WHEREAS, said uneconomic remainder serves no useful purpose to the Columbus

Consolidated Government and it is considered to be in the best interest of

Columbus, Georgia to Quit Claim same to Bobby G. Penny and Connie Penny in

exchange for the fair market value of said uneconomic remaining property, being

the difference between the Fair Market Value of the required right of way of

the Penny's property less the Fair Market Value of the remaining property; to

be paid to the City at closing.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute a Quit Claim

(0.176 acres) to Bobby G. Penny and Connie Penny in exchange for fair market

value of said uneconomic remaining property, being the difference between the

Fair Market Value of the required right of way of the Penny property less the

Fair Market Value of the remaining property (5r and a portion of 6r) to be

paid to the City at closing , for the St. Mary's Road Project STP-8038-(7)
