A Resolution Authorizing THE CITY MANAGER TO NEGOTIATE AND EXECUTE A FIVE (5) YEAR PROPERTY LEASE
AGREEMENT WITH FORESITE, LLC FOR THE PURPOSE OF LEASING GROUND SPACE AT THE
CITY'S SCHATULGA ROAD PROPERTY TO INSTALL AND OPERATE A TELECOMMUNICATION
FACILITY.
WHEREAS, Foresite LLC desire to lease ground space at 3950 Schatulga Road to
the rear of the City's Heavy Equipment Yard and is approximately 10,000 square
feet as described in EXIBIT 1. whereas, the purpose of the lease agreement is to install and operate a
telecommunications tower and equipment facility to provide a new cellular
telephone service for this community; and,
whereas, the proposed tower site was reviewed by the Traffic Engineering Division &
Community Reinvestment and has been coordinated with the Public Services
Department so as not to interfere with their operation; and,
WHEREAS, the lease agreement was negotiated to provide the City $12,000.00 rent
per year for the first five year term with provision for a 15% increase of rent
for any future terms; and
WHEREAS, the executed ground lease agreements will become part of this
resolution by reference and will be filed with the Clerk of Council
That the City Manager is hereby authorized to negotiate and execute a
five (5) year property lease agreement with Foresite, LLC for the purpose of
leasing property within the property of 3950 Schatulga Road (as shown in
exhibit 1) to install and operate a telecommunications tower and equipment
facility with executed agreement becoming part of this resolution by reference.
