A Resolution Authorizing THE CITY MANAGER'S TO ACCEPT 2.424 ACRES +/- FROM THE COLUMBUS BUILDING

AUTHORITY AND TO ACCEPT 0.266 ACRES +/- FROM THE GEORGIA POWER AND LIGHT AND TO

TRANSFER A TOTAL OF 3.475 ACRES +/- OF PROPERTY TO FOUNDATION PROPERTIES,

INC., FOR THE DEVELOPMENT OF THE UPTOWN CAMPUS FOR COLUMBUS STATE UNIVERSITY. whereas, the City owns 3.475 acres of property (including a portion of Bay Avenue

previously declared as surplus) of which 2.424 acres was transferred to the

Columbus Building Authority to enable financing of the construction of a

portion of the River Walk project by using Revenue Bonds Series 1992, and, .266

acres +/- transferred from Georgia Power and Light, and;

WHEREAS, the Building Authority will transfer the 2.424 +/- acres of property

back to the City of Columbus and, Georgia Power and Light will transfer .266

acres +/- to the City of Columbus. The City of Columbus will transfer the

property to Foundation Properties, Inc.

WHEREAS, it is in the best interest of the City of Columbus, Georgia to

transfer a total of 3.475 acres of property to Foundation Properties, Inc.;

and,
whereas, the City of Columbus, Georgia will transfer said property in accordance with

section 501 of the City code.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to:

1. Accept 2.424 +/- acres of property from the Columbus Building Authority,

2. Accept 0.266 +/- acres of property from the Georgia Power and Light,

2. Declared surplus 3.475 +/- acres of property (to include the 2.424 acres

and 0.266 acres, and other adjacent City owned property and that portion of Bay

Avenue) designated on that certain map or plat entitled "Survey of City Lots 1,

2 & Part of 3, Part of Water Lots 34, 35, 36 and 37, prepared by Hobbs Smith &

Assoc., Inc., under date of March 11, 2004"; and,

3. Transfer the said 3.475 +/- acres to Foundation Properties, Inc., for

development of the uptown campus for Columbus State University Campus, with a

reversionary clause that should the property no longer be used for university

purposes the property will revert into the ownership of the City; and,

4. File all deeds with the Clerk of Superior Court of Muscogee County, Georgia.
