amendment creating a time limit concerning tabled cases, be approved. A copy

Application

The Planning Division is proposing to create a time limit concerning tabled

zoning cases. Zoning cases that are submitted to the Planning Division can be

tabled at any time for an indefinite period. Currently, there are three cases

that have been tabled for over one year. The Planning Advisory Commission has

heard all three cases and the Commission has passed recommendations on the

aforementioned cases. The applicants have asked that their cases be tabled

before the Planning Division submits a recommendation to Council. The text

amendment will limit the period of time to table a case to six (6) months,

regardless of where the case is in the zoning process.

Proposed Text Amendment

Amend Sec. 22-36 Administration of Chapter as follows:



Add Sec. 22-36 (C)(3.1) to read as follows:



(C) Amendment to Zoning Ordinance:



(3.1) Tabling of petition. Tabling of a petition to amend the zoning atlas or

text by the applicant is permitted for no more than six (6) months. An

applicant choosing to table a case, regardless of where it is in the rezoning

process, shall make their request formally by a letter to the planning

division. When a petition is tabled by the applicant, the

applicant shall not be allowed to table the petition at any other time during

the rezoning process.

Planning Advisory Commission Recommendation

The Planning Advisory Commission considered this text amendment at their

meeting on

September 17, 2003. The Planning Advisory Commission recommended approval of

the text amendment.

Planning Department Recommendation

The Planning Division recommends approval of text amendment.
