Subject: (ZC0205-6) Request to amend the text of the zoning ordinance to allow

amusements, recreational and entertainment activities carried on wholly within

a permanently enclosed building, excluding adult movie houses, as a Special

Exception Use in an M-1 (Light Manufacturing) Zoning District.

Ken Spano is proposing an amendment to Section 22-23 M-1 light manufacturing

district. The purpose of the amendment is to allow schools, non-degree, such

as business colleges and dancing schools, as a Special Exception Use. The text

change will give individuals increased access to facilities that meet their

needs. A cheerleading or gymnastics school needs high ceilings and tend to be

noisy. This type of use / facility may not be desirable / accessible in a

commercial zone. The Special Exception Use will allow the Planning Division to

assess the impact that this use could have on the character of the district,

public health, and safety on a case-by-case basis.



The Planning Advisory Commission considered this text amendment at their

meeting on June 19, 2002. The Planning Advisory Commission recommended that

this text change be approved as Schools, non-degree, such as business colleges

and dancing schools, as a Special Exception Use.



The Planning Division recommends the adoption of the proposed text amendment as

amusements, recreational and entertainment activities carried on wholly within

a permanently enclosed building, excluding adult movie houses, as a Special

Exception Use (the applicant concurs with this recommendation).
