PLANNING ADVISORY COMMISSION RECOMMENDATION
The Planning Advisory Commission recommends conditional approval based upon the

fact that it is consistent with the future land use map of the Comprehensive

Plan, it is compatible with existing land-uses, and it does not constitute spot

zoning. The recommended conditions are: 1) all lighting shall be directed

internally using deflector shields, 2) screening for trash dumpsters /

compactors, air conditioners, refrigeration units, and heat pumps shall be

required for all development on the property, and 3) driveway access shall be

determined by the City Traffic Engineer.

PLANNING DEPARTMENT RECOMMENDATION
Conditional approval based on the fact that it is consistent with the future

land use map of the Comprehensive Plan and it is compatible with existing

land-uses. The recommended conditions are the same as those recommended by the

Planning Advisory Commission.

Environmental Impacts
The property does lie within a floodway and floodplain area. The developer

will need an approved drainage plan prior to issuance of a Site Development

permit, if a permit is required.

The proposed project is not expected to have a negative impact on the

transportation network. The current traffic count is 22,144 trips per day and

will stay the same following rezoning. The Level Of Service will remain at D

(24,500 trips per day) for 13th Street.

Attitude of Property Owners
Fifteen (15) property owners within 300 feet were notified of the rezoning

request. The Planning Division did not receive any comments concerning this

rezoning request.
Additional Information
Several issues have arisen concerning this rezoning:



? The property is being used to store concrete products (bird baths, statues,

etc.). This use is not appropriate for C-2; it does not serve a neighborhood

need.

? By changing the zoning to C-3, the applicant is making the use and the zoning

compatible.

? This lot and the lot to the west are the only two lots on this block that are

zoned C-2.

C-2 zoning is more appropriate for the commercial uses that are east of 13th

Avenue, such as The Village on 13th, Lewis Jones, Sho-Place, etc.

? The properties to the north and west are more appropriate for C-3 uses, such

as TIC, Direct Optical Center, Tire King, etc.
