- PLANNING ADVISORY COMMISSION RECOMMENDATION
- The Planning Advisory Commission recommends conditional approval based upon the
fact that although it is not consistent with the future land use map of the
Comprehensive Plan, it is compatible with existing land-uses, it is served by
water and sewer, and it does not constitute spot zoning. The recommended
conditions are: 1) all lighting shall be directed internally using deflector
shields, 2) any external trash dumpsters / compactors shall be visually
obstructed by a structure that is aesthetically similar to the proposed
project, 3) no external trash dumpsters / compactors shall be permitted along
the property lines bordered by the R-2 zoning district, 4) left turn lanes
shall be required as determined by the City Traffic Engineer, 5) only one
access to the proposed development shall be permitted, 6) a right turn lane on
St. Mary?s Road shall be required as determined by the City Traffic Engineer,
7) ingress and egress of this site shall align with the Northstar Drive
intersection, 8) screening for air conditioners, refrigeration units, and heat
pumps shall be required for all development on the property, 9) no more than
forty (40) townhouses / condominiums shall be permitted on the property subject
to rezoning, 10) the forty (40) townhouses / condominiums shall be located
along the northern and eastern sides of the lake, and 11) the remaining
property shall be developed as single family residential, excluding patio homes
/ zero lot line homes.

- The property does not lie within a floodway and floodplain area. The developer
will need an approved drainage plan prior to issuance of a Site Development
permit, if a permit is required.

- The portion of St. Mary?s Road between Farr Road and McCartha Drive is
scheduled for widening with right-of-way acquisition beginning in 2004 and
construction starting in 2010 (may be subject to change). There are currently
no plans to widen St. Mary?s Road east of McCartha Drive. The current traffic
count is 8,777 (average over 5 weekdays) trips per day and will increase to
9,346 trips per day. The Level Of Service will increase to C (11,800 trips per
day) for this section of St. Mary?s Road.

- Forty-nine (49) property owners within 300 feet were notified of the rezoning
request. The Planning Division received several comments opposing the original
request for R-4 (High Density Residential). The community leaders in the area
and the applicants reached a compromise by amending the request to R-3A (Medium
Density Residential) and limiting the amount and types of development.
