Subject: (ZC0208-1) Special Exception Use request for a day care center at 5325 Forrest

Road. NOTICE OF PLANNING DIVISION APPROVAL.

Resolution approving a Special Exception Use for a day care center at 5325

Forrest Road (see Attached Map).

The applicant, Rev. James Herring, submitted an application for a Special

Exception Use at the above referenced property. The property encompasses 12

acres in R-4 (High Density Residential), R-2 (Low Density Residential), A-O

(Apartment-Office), and C-2 (Neighborhood Shopping) zoning districts. The site

of the day care will be in the R-4 section of the property. The applicant

seeks to open a day care center, New Revival Christian Academy, on the

property. Day care centers are allowed in an R-4 district only on a

site-specific basis and upon approval by the Planning Division and the

Council. The granting of a Special Exception Use must be based upon the

following criteria and conditions:

  1. Access. - Is or will the type of street providing access to the use be adequate to serve the proposed special exception use?
    The proposed day care center school is located at 5325 Forrest Road, which is a

    five-lane road. There is single family residential, neighborhood commercial

    (banks, shopping centers, etc.), and various religious uses (churches, church

    day care centers, and church schools) located around the Forrest Road-Woodruff

    Farm Road-Floyd Road intersection. Planning staff believes the day care center

    would not prove detrimental to the public health, safety and welfare (and

    vice-versa).
  2. Traffic and Pedestrian Safety. - Is or will access into and out of the property be adequate to provide for traffic and pedestrian safety, the anticipated volume of traffic flow, and access by emergency vehicles?
    The proposed Special Exception Use will not be injurious to the

    surrounding property values since the proposed use is bordered by uses that

    would be accepted in a commercial zone and a residential zone.
  3. Adequacy of Public Facilities. - Are or will public facilities such as schools, water or sewer utilities, and police or fire protection be adequate to serve the special exception use?
    The subject site is zoned R-4. There is a day care center located on

    Hunter Road; a church with a full school located at 1603 Floyd Road; and a

    proposed church and church owned HUD 202 apartment complex that will be

    located at 2423 Woodruff Farm Road. There are also residential areas near the

    proposed use. The church and the day care would be compatible with all uses

    in the area.
  4. Protection from Adverse Affects. - Are or will refuse, service, parking and loading areas on the property be located or screened to protect other properties in the area from such adverse effects as noise, light, glare or odor?
    The Buffer Ordinance requires a Level C buffer along the parcels zoned

    R-2.
  5. Hours of Operation. - Will the hours and manner of operation of the special exception use have no adverse effects on other properties in the area?
    Parking for the property will be accessed from Forrest Road. The size

    of the lot and the placement of the buildings allow for much of the lot to

    serve as parking.
  6. Compatibility. - Will the height, size or location of the buildings or structures on the property be compatible with the height, size, character or location of buildings or other structures on neighboring properties?
    Not applicable.

Twenty-three (23) property owners within 300 feet of the parcel were notified

by letter of the proposed Special Exception Use and the required notification

sign was posted on the property. The Planning Division received no comments on

this project.
