Subject: Special Exception Use application has been received



On July 13, 2003, St. Thomas Episcopal Church submitted a Special Exception Use

application for a day care center at 2100 Hilton Avenue and 2500 Woodcrest

Drive (contingent upon rezoning). The day care center has been in existence

for 43 years. It is an existing, non-conforming use that has been

grandfathered concerning the zoning. They currently are open from 8:00 AM to

Noon. They wish to expand their hours to 8:00 AM to 5:00 PM. An existing,

non-conforming use cannot be expanded. The property is zoned R-1A (Low Density

Residential). The property is in the process of being rezoned to R-3 (Medium

Density Residential). A day care center is allowed in the R-3 zoning district

as a Special Exception Use.



Attached is a map showing the location of the property. Planning Division

staff is currently reviewing the request. We project the request will be on

Council?s September 9th agenda. A staff report will be sent to the Clerk of

Council prior to the Council meeting date.
