In 1998, Leon's Fabrics (a wholesale operation) was relocated from the downtown
area due to the redevelopment activities and the Total System development and
allowed to relocate at 2120 Warm Springs Road. The property at that time was
zoned Neighborhood Commercial (C-2). Technically, wholesale operations are not
an allowable use under a C-2 classification. However, permission was granted
by a previous administration to allow this business to locate in this zone.
This use has functioned well at this location.
The owner is now requesting that another upholstery shop be allowed to operate
in a separate building he owns that faces Warm Springs Road. The current
Unified Development Ordinance reflects the same requirements as the previous
zoning ordinance and does not allow for upholstery shops in Neighborhood
Commercial (NC) zones.
To remedy this situation immediately, staff is prepared to issue a Certificate
of Occupancy for the new upholstery shop. This action is based upon the fact
that the City has already allowed a similar type of business in this same
zone. In doing so however, the applicant has been reminded that this use will
be considered a nonconforming one, and that should this use stop or be
destroyed more than 50 percent, the City cannot issue a new Certificate of
Occupancy. Rezoning of the property to a General Commercial (GC) zone, which
allows these uses, has also been encouraged. Mr. Hudson has been informed of
this situation.
