The Regular Meeting of the Board of Zoning Appeals was held Wednesday, August

6, 2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

CASES TABLED FROM THE JULY 2nd MEETING.



Case No. 03-V77?Denied.



Daniel Peak, 2026 Preston Drive, and John Peak (his brother) presented the

appeal for a variance to reduce the rear yard setback requirement from 30 feet

to 8 feet, in order to subdivide a lot to erect a single family residence. The

property is zoned R-1A. Contingent upon replat approval.



In their statements and in response to questions from the Board Members, they

gave the following information: He did meet with the neighbors because there

was a lot of opposition at last months meeting to discuss what he was going to

do. The whole idea is not to prove that there is a hardship, but this is a

reverse hardship. The house could be erected because it meets the requirement

for the minimum 10,000 square feet. They are trying to keep the new house away

from the Flournoy?s lot. The new house will not decrease the property value to

the other homes.



Planning agrees that this is considered a reverse hardship and Mr. Peak would

be able to subdivide the lot into two lots without a variance. By getting the

variance he would be moving the house further away from the neighboring

property and closer to his brother.

When the Chairperson asked for opposition, Charles & Laura Kate Rambo,

Moffett & Molly Flournoy, Mike & Dorothy Stafford, Ed & Ann Schuan, Paula

Hecht, Banks Carrol, John & Amanda Mueller, came forward. They reasons for

opposition were: you can?t create your own hardship, according to the R-1A code

only one single family residence per existing lot of record, the property has

been treated as a single lot for the past 50 years, this will now be a spec

buy, credibility of the requestors (Daniel stated at the first Board meeting

that he would live in the house, now he is planning not to live in the house,

but sell it) and harm to the neighborhood (sewage problems & water drainage).

There was also a petition with 50 signatures of neighbors who oppose this

request. They did have a meeting with the Peak?s and do not feel any better

about the plans.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to deny this

appeal because there were many people in opposition to this request. Motion

carried unanimously.



Case No. 03-V82--Denied.



There was no one present to present the appeal of Dana Horne, 5414 15th Avenue,

for a variance to reduce the required number of off-street parking spaces from

16 to 15. The property is zoned A-O.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to

deny this appeal because there was no one present to present the

appeal for two consecutive meetings. Motion carried unanimously.



Case No. 03-HO178--Denied.



There was no one present to present the application of Rodney Cooper, 6026

Frazier Drive, for a Certificate of Occupancy for a Home Occupation for an

office only for computer generated monthly publication, Underground Columbus.

The property is zoned R-1.

There was no one present to present the application of Sara Heinrich, 3106

Hatcher Drive, for a Certificate of Occupancy for a Home Occupation for an

office only for import/export of pottery, clothes, jewelry, accessories and

household items (items will be sold at shops), Real Import/Export. The

property is zoned R-1A.



There was no opposition to this application.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to deny this

application because there was no one present to present the application for two

consecutive meetings. Motion carried unanimously.



Case No. 03-HO187--Denied.



There was no one present to present the application of William E. Webb Jr.,

11241 Chattsworth Road, for a Certificate of Occupancy for a Home Occupation

for an office only for an on line e-bay merchandise business (sporting items),

W & W Merchandise. The property is zoned A-1.



There was no opposition to this application.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to deny this

application because there was no one present to present the application for two

consecutive meetings. Motion carried unanimously.



Case No. 03-HO191--Granted.



Sandra Rios, 4956 Harbin Street, presented her application for a Certificate of

Occupancy for a Home Occupation for making & selling bath products (internet),

White Rabbit?s Herbals. The property is zoned R-2.

applicant gave the following information: She will have no employees and there

will be no additional traffic in the neighborhood. This will be part time

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this

application because it does meet the intent of the Home Occupation definition.

Motion carried unanimously.



Case No. 03-HO199--Denied.



Mary Southerland, 1817 Celia Drive, presented her application for a Certificate

of Occupancy for a Home Occupation for an office only for selling crafts &

clothing (items will be sold at flea market), Gifts & What-Nots. The property

is zoned R-2.



In her statement and in response to questions from the Board Members, the

applicant gave the following information: She will be using one room as an

office only. She will have no employees and there will be no additional

traffic in the neighborhood. This will be part time work. She did live at

1817 Celia Drive with her adult children, but she now lives in a different

location (663 Morris Road). She would like to use the home that her children

presently live in to run her business (1817 Celia Drive).



There was no opposition to this application.



Mr. King made a motion, which was seconded by Mr. Edwards, to deny this

application because Ms. Southerland does not live at 1817 Celia Drive, she

moved to a new residence. Motion carried unanimously.

VARIANCES.



Case No. 03-V86--Granted.



James Bradley, 930 Eden Street and Jimmy Weaver of Air Flow Awning presented

the appeal for a variance to reduce the side yard setback requirement from 8

feet to 4 feet, in order to make an addition, 14? x 21?, a carport, to a single

family residence. The property is zoned R-1A.



In his statement and in response to questions from the Board Members,

Mr. Bradley gave the following information: They moved into the house 2 years

ago and recently had two babies. They decided to have a carport to protect

them from the weather. He had three estimates to come out and asked if it was

o.k. to put the carport inside the property line 3 to 4 feet up and he was told

that it was legal. He gave the o.k. to put up the carport. When the carport

was put up the company did not have a building permit. They did not get a

building permit because of miscommunication. There are similar carports in the

area. The water will flow to the front. The carport is over an existing

slab.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this

appeal even though the carport is already in place. Tearing down the carport

would be a financial hardship for Mr. Bradley. Motion carried unanimously.



Case No. 03-V87?-Granted.



Kathy Evers, 627 3rd Avenue, presented her appeal from a Decision of

the Building Official that an accessory structure is not allowed in the side

yard. The property is zoned H.



In her statement and in response to questions from the Board Members, Ms. Evers

gave the following information: She bought the house 1 year ago after it was

renovated. She would like to build a storage building in the side yard. She

has been approved by BHAR. She has a wide lot. The storage building will

match the house and will fit in with the area. She has trees in the back yard

that she does not want to cut down.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal,

even though the Building Official is correct, to allow the accessory structure

in the side yard. BHAR has given approval. Motion carried unanimously.



Case No. 03-V88?-Granted.



Rick Fenney and Arnold Gaylord presented the appeal of Pezold Management

Associates, 4747 Hamilton Road, for a variance to increase the size of a sign

from 300 square feet to 468 square feet, 2 signs are allowed. The property is

zoned C-3.



In their statements and in response to questions from the Board Members, they

gave the following information: This building was an old Gaylord store in the

past and they would like to give it a face lift. They would like to increase

the size of a sign from 300 to 468 square feet. They will add four tenant

panels between the three poles. They painted the poles and added new lighting.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal

to increase the size of a sign from 300 square feet to 468 square feet because

this will enhance the area. Motion carried unanimously.



Case No. 03-V89?-Granted.



Jessie Gunn, 3530 Ambassador Drive, presented the appeal for a variance to

reduce the side yard setback requirement from 8 feet to 4 feet, in order to

make an addition, 20? x 26?, a carport, to a single family residence. The

property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr. Gunn

gave the following information: He would like to build a carport for 2 cars.

The carport will be over an existing slab. The same materials will be used to

match the house.

Case No. 03-V90?-Granted.



Gregory Wilder, 744 Corley Drive, presented his appeal for a variance to reduce

the side yard setback requirement from 8 feet to 3 feet, in order to make an

addition, 12? x 19?, a carport, to a single family residence. The property is

zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Wilder gave the following information: He is in the military and will be

relocating his family to this area. He would like to build a carport over an

existing pad. The same materials used will match the house. There will not be

a problem with the water, it will have gutters and the water will flow to the

street.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

because the carport will be over an existing pad and gutters will be added to

control the water flow. Motion carried unanimously.



Case No. 03-V91?-Granted.



Robert G. Whitten, II, 3A Bradley Park Court, presented his appeal for a

variance to reduce the rear yard setback requirement from 15 feet to 12 feet,

in order to erect an office building, 42? x 112?. The property is zoned

M-1.



In his statement and in response to questions from the Board Members,

Mr. Whitten gave the following information: He has 2 tenants. He is expanding

a law firm and adding another tenant. It takes 4 months to get with the

engineers and architects. If he has to go through this again it will be costly

and he may not have tenants. The back of the building is where the dumpster

and the railroad is, which will give a front door and side door. The

Building department says that we need a front door and back door. The Building

department considers the side yard the back yard. The new building will back

up to Wright?s Construction Company and it is not infringing on anyone. The

materials, color scheme, and architectural is similar to the other building.



Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal

because he has tenants already and if he had to re-do the plans it would be an

economical hardship. Motion carried unanimously.



Case No. 03-V92?-Granted.



David Fox presented the appeal of Tiger Creek Development, Inc., 6801 Warm

Springs Road (Lot 18), for a variance to reduce the lot width from 75 feet to

66 feet, in order to erect a single family residence. The property is zoned

R-1A. Contingent upon Planning approval.



In his statement and in response to questions from the Board Members, Mr. Fox

gave the following information: These three lots are in a subdivision that

they are platting. In the preliminary platting process, they underwent a

review on how they measure the building line on an arc particularly in a

cul-de-sac. The cul-de-sac that is in question out of these three lots back up

to a large creek and they purposely held the cul-de-sac back away from the

creek. When they did that it forced our tangent building line on the arc

roughly 60 feet rather than the 75 feet that is required. They had room to

encroach further on the creek and keep their lot sizes to the minimum required

if they extend the road towards the creek another 20 or so feet to get the 75

feet, but they felt like they didn?t want to encroach on the creek and the

green space that is there any more than they had to. Lots 18 and 19 are pretty

large, lot 19 is the largest. Lot 20 is the one that has the closest

encroachment on the creek.

There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal

because these are cul-de-sac lots and odd shaped lots are hard to keep the

exact distance at the property line, but the size of the lots are well big

enough to put any type home they wanted on them. Contingent upon Planning

approval. Motion carried by the affirmative vote of four Board Members, with

Mr. Fox abstaining from the vote.

Springs Road (Lot 19), for a variance to reduce the lot width from 75 feet to

66 feet, in order to erect a single family residence. The property is zoned

R-1A. Contingent upon Planning approval.



In his statement and in response to questions from the Board Members,

Mr. Fox gave the following information: These three lots are in a subdivision

that they are platting. In the preliminary platting process, they underwent a

Joel and Kristy Boswell, 6115 Warner Road, presented their appeal from a

Decision of the Building Official that an accessory structure must be in the

rear yard and it must be at least 5 feet from the side property line, 4 feet

shown. The property is zoned R-1.



In their statements and in response to questions from the Board Members, Mr.

and Mrs. Boswell gave the following information: They have a big lot. They

built a shed to store their motorcycles and lawn mower. It has no power going

to it and it has roll up doors. When they built the shed they put it in the

side yard not knowing that they needed a building permit.

They didn?t put the shed in the rear yard because in the future they are going

to put in a swimming pool and there are two storage sheds already in the rear

yard. They have a letter from their neighbor, Scott & Connie Gillens, 6113

Warner Road, who are not opposed to this request.

Mr. King made a motion, which was seconded by Mr. Fox, to grant this appeal,

although the Building Official is correct. The accessory structure is already

in place and it would be an economical hardship to move it. Motion carried

unanimously.



Case No. 03-V96?-Granted.



Ernie Wright presented the appeal of Ray M. Wright, Inc., 9006 Seedling Drive,

for a variance to reduce the rear yard setback requirement from 30 feet to 27

feet, in order to erect a single family residence, 40? x 46?. The property is

zoned R-2.



In his statement and in response to questions from the Board Members, Mr.

Wright gave the following information: They would like to reduce the rear yard

setback requirement in order to build a house. The house will be built on an

odd shape lot. They have future development going in the rear of this lot.

Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal

to reduce the rear yard setback requirement from 30 feet to 27 feet so that

they can build a house. Motion carried unanimously.



Case No. 03-V97?-Withdrawn.



This appeal was withdrawn at the request of the appellant Debra Freeman, 7920

Shallowford Road, for a variance to reduce the lot width requirement from 125

feet to 30 feet. The property is zoned A-1.

Case No. 03-V98--Granted.



Gail Aderhold, Action Buildings, presented the appeal of Don Watson, 1210 49th

Street, for a variance to reduce the side yard setback requirement from 15 feet

to 4 feet, in order to make an addition, 14? x 30?, a garage, to a single

family residence. The property is zoned C-3.



In her statement and in response to questions from the Board Members,

Ms. Aderhold gave the following information: Mr. Watson would like to make an

addition to his commercial building. The garage will fit in line with the one

across the street. If it were not for the spot zoning in the area with the

adjoining property they wouldn?t need a variance. On the side of his property

there is a 15 foot alley that separates the property. The alley is not clearly

seen because of sheds and the chickens that are being raised

there.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this

appeal to reduce the side yard setback requirement from 15 feet to 4 feet to

make an addition to a commercial building. Motion carried unanimously.



Case No. 03-V99?-Granted.



Ben Moon presented the appeal of Joe S. Laudersale Sr., 308 6th Street,

for a variance to reduce the lot area from 4,000 square feet to 2,526 square

feet, in order to subdivide a lot. The property is zoned H. Contingent upon

Planning approval.



In his statement and in response to questions from the Board Members, Mr. Moon

gave the following information: Through the years, Mr. Lauderdale has

accumulated parcels on the corner of 3rd Avenue and 6th Street. He presently

owns 8 different parcels of land. Some of the property lines go through

buildings and all around. They are taking 6 lots and making 4 out of them.

One lot is vacant and the width is not changing, they are squaring up the

corners. The other three lots have less than the required number of square

feet.

Ben Moon presented the appeal of Joe S. Laudersale Sr., 310 6th Street, for a

variance to reduce the lot area from 4,000 square feet to 2,875 square feet, in

order to subdivide a lot. The property is zoned H. Contingent upon Planning

approval.



In his statement and in response to questions from the Board Members, Mr. Moon

gave the following information: Through the years, Mr. Lauderdale has

accumulated parcels on the corner of 3rd Avenue and 6th Street. He presently

owns 8 different parcels of land. Some of the property lines go through

buildings and all around. They are taking 6 lots and making 4 out of them.

One lot is vacant and the width is not changing, they are squaring up the

lot. The property is zoned C-3. Contingent upon Planning approval.

Patricia Ann Wells, 6217 Valencia Drive, presented her application for a

Certificate of Occupancy for a Home Occupation for making uniforms, Gifts of

Beauty. The property is zoned R-3A.



In her statement and in response to questions from the Board Members, the

applicant gave the following information: She will make uniforms for Doctors

and nurses. She will have no employees and there will be no additional traffic

in the neighborhood. She will deliver the uniforms to her clients. This will

be full time work.



There was no opposition to this application.

application because it does meet the intent of the Home Occupation definition.

There was no one present to present the application of Brian Sorrells, 1439

18th Avenue, for a Certificate of Occupancy for a Home Occupation for an office

only for a network consulting service, Sorrells Network Services. The property

is zoned R-3A.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to

table this application until the September meeting because there

was no one present to present the application. Motion carried

Case No. 03-HO208--Granted.



Sandra Railey, 5869 East Heights Drive, presented her application for a

Certificate of Occupancy for a Home Occupation for a beauty salon, Cuts &

Styles by Sandra. The property is zoned R-1.



In her statement and in response to questions from the Board Members, the

applicant gave the following information: She has owned her salon (commercial

site) for 32 years. She would now like to have her beauty salon in her home.

She needs to take care of her granddaughter who has health needs and has to

have around the clock care. She will have 1 work station, 4 or 5 clients a day

not past 5:00 p.m., Monday thru Friday only, no weekends. She will have no

employees. This will be part time work. She has a 2 car driveway for

additional parking.

There was no one present to present the application of Fidel Garcia, 3212

Plateau Drive Lot 99, for a Certificate of Occupancy for a Home Occupation for

an office only for a landscaping business, Garcia Landscaping. The property is
