The Regular Meeting of the Board of Zoning Appeals was held Wednesday, May 5,
2004 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
Board Member Leah Braxton was unable to attend the meeting. Mr.
Edwards made a motion, which was seconded by Mr. Lewis, to excuse Ms. Braxton?s
absence on today, May 5, 2004, for personal reasons. Motion carried
unanimously by the four Board Members present for this meeting.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to approve
the Minutes of the Monthly Meeting, which was held on April 7, 2004. Motion
carried unanimously by the four Board Members present for this meeting.

There was no one present to present the application of Jenauhd Bradford, 6211

Case No. 04-V53--Granted.
Robert Teasley, Signs, Inc., and Dicky Edge, of Muldoons, 6483 Veterans
Parkway, presented the appeal from a Decision of the Building Official that an
additional sign is not allowed. The property is zoned C-3.
In their statements and in response to questions from the Board
Members, Mr. Teasley and Mr. Edge gave the following information: This is a
shopping center on the corner of Veterans Parkway and Whittlesey Road. There
is an existing sign, which is on the front corner, but hidden by a package
store. The portable sign will be removed once the new sign is put up. Mr.
Edge is approximately 35 feet short of having 300 feet frontage on the road
that would allow him to have a second sign had they not sold the

out parcels. The sign will be 19 feet tall, if they counted the whole frontage
of the shopping center, they would have been allowed up to 300 square feet on
both signs.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal with the stipulation that the portable sign will be removed. The
property would have been large enough for another sign if they had not sold the
out parcel. It would be a hardship on the business if they were not allowed to
have an additional sign because they sit back far from the road and it would be
hard to see. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 04-V54?-Granted.
Robert Teasley, Signs Inc., and Howard Tibbet and Rob Doll of Rob Doll Nissan,
1600 Box Road, presented the appeal for a variance to increase the height of a
2nd sign from 35 feet to 63 feet 3 inches. The property is zoned C-3.
In their statements and in response to questions from the Board
Members, Mr. Teasley, Mr. Tibbet and Mr. Doll gave the following information:
The sign will be 63 feet 9 inches and not 63 feet 3 inches. This is a multiple
franchise car lot. The view headed south is pretty clear, but they are trying
to get the north side read, the height is needed because of the tree line. The
top sign is existing and the proposed sign is a much nicer up to date sign.
They are taking down a sign and putting up a new sign.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant
this appeal because in the super imposed signs that Mr. Teasley showed the
Board the sign will not be seen traveling North on I-185 if it was at 35 feet,
otherwise they would have to remove some trees. Motion carried by the
affirmative vote of the four Board Members present for this meeting.

Case No. 04-V55?-Granted.
Charles Stevenson, 1229 Cedar Avenue, presented the appeal for a variance to
reduce the side yard setback requirement from 10 feet to 7 feet 8 inches, in
order to make an addition, 13? 7? x 24? 2??, a bathroom and closet, to a single
family residence. The property is zoned R-4.
In his statement and in response to questions from the Board Members, Mr.
Stevenson gave the following information: The request should be 7 feet 6
inches instead of 7 feet 8 inches. He would like to extend the house so the
roof can line up with the overhang. The same materials will be used to match
the house.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
to change the reduction to 7 feet 6 inches because this will continue the
existing house on the back and they are using similar materials. Motion
carried by the affirmative vote of the four Board Members present for this

Case No. 04-V56?-Granted.
Gene Mathews, 2508 Techwood Drive, presented the appeal from a Decision of the
Building Official that an accessory structure is not allowed in the side yard.
The property is zoned R-1A.
In his statement and in response to questions from the Board Members,
Mr. Mathews gave the following information: He would like to build a carport
with a storage room behind the driveway. The carport will go over an existing
slab. There is a brick wall and he would like to get as close to it as
possible. He will have gutters installed to divert the water from the
neighbors. The side yard requirement will be reduced from 5 feet to 1 foot and
the distance between structures will be reduced from 6 feet to 5 feet.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal
because the carport will be built over an existing slab, although the Building
Official is correct that an accessory structure is not allowed in the side
yard. Gutters will

be added to the side of the carport. The side yard requirement will be reduced
from 5 feet to 1 foot and the distance between structures will be reduced from
6 feet to 5 feet. Motion carried by the affirmative vote of the four Board

Case No. 04-V57?-Granted.
Tom Cantrell, Builder, presented the appeal of James Dorchak, 8916 River Road,
from a Decision of the Building Official that an accessory structure is not
allowed in the side yard and to increase the height of an accessory structure
from 14 feet to 21 feet. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr.
Cantrell gave the following information: Mr. Dorchak would like to put a
detached garage in the side and vary the height on it. These lots are really
not lots, they are called parcels. This particular building site is
approximately 7 acres. The building will not be within 150 feet of any of the
property lines. These lots don?t fit the front, side and rear yard because the
street is in a widening manner that some face the street and some face the side
of the lots, what we call a front yard becomes a rear yard. Every completed
home in the subdivision has an out building of some type, either in the front,
side or rear yard depending on how they oriented the original home. The house
is 300 feet from the street. The majority of the houses are not seen from the
street because it is extremely wooded.

Mr. King made a motion, which was seconded by Mr. Edwards, to grant
this appeal, although the Building Official is correct that an accessory
structure is not allowed in the side yard, it will be 300 feet from the road
and will not be visible from the private drive and to allow the height to be
increased from 14 feet to 21 feet. This is not uncommon in this neighborhood,
side yards could be considered the rear yard. Motion carried by the
affirmative vote of the four Board Members present for this meeting.

Case No. 04-V58?-Granted.
Dave Erickson, Pinnacle Homes, Inc., 8091 Creekland Drive, presented the appeal
for a variance to reduce the front yard setback requirement from 25 feet to 19
feet 6 inches, in order to erect a single family residence. The property is
zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Erickson gave the following information: He would like a request to move the
house forward at the end of Creekland Drive. This is a tight lot, there is a
creek immediately in the rear and a sewer easement. He is trying to use a
floor plan in the subdivision that is consistent with the rest of the houses he
is doing in Big Creek. Alternatively, he could make it work with the existing
lot, but he would have to go to a stacked two story house and he has no two
story houses in the neighborhood, so he would prefer not to do that. He feels
the best thing to do is move the house forward which would balance the front
yard with the back yard and keep them away from the creek.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
to move the house forward to the road and get it away from the creek and keep
the design contiguous with the rest of the neighborhood. Motion carried by the
affirmative vote of the three Board Members present with David Fox abstaining
from the vote.
