The Regular Meeting of the Board of Zoning Appeals was held Wednesday, March 6,

2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

CASES TABLED FROM THE JANUARY 23RD MEETING.



CASE NO. 02-HO13---Granted.



Lee Carlton Swift, 926 Blandford Avenue, presented her application for

a Certificate of Occupancy for a Home Occupation for an office only for

designing & planting gardens, Maypop, Inc. The property is zoned R-1A.



In her statement and in response to questions from the Board Members,

the applicant gave the following information: She will be using an office

only. There will be no employees and no additional traffic. This will be part

time.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant

this application because it does meet the intent of the Home Occupation

definition, but with the stipulation that there will be no storage of work

material at the residence. Motion carried unanimously.









BOARD OF ZONING APPEALS 03/06/2002





CASE NO. 02-HO15---Granted.



William Mark Suddeth, 5405 Richmond Avenue, presented his application

for a Certificate of Occupancy for a Home Occupation for an office only for

installing garden ponds, Creative Waterscapes. The property is zoned R-1A.



In his statement and in response to questions from the Board Members,

the applicant gave the following information: He will be using an office

only. There will be no employees and no additional traffic. This will be full

time.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant

this application because it does meet the intent of the Home Occupation

definition, but with the stipulation that there will be no storage of work

VARIANCES.



Case No. 02-V39?-Granted.



Steve Thorpe presented the appeal of Billy & Bernice Pollard, #95 Mathews

Street, for a variance to reduce the rear yard setback requirement from 30 feet

to 15 feet, in order to make an addition, 16? x 17?, a bedroom and bathroom, to

a single family residence. The property is zoned R-2.



In his statement and in response to questions from the Board Members, Mr.

Thorpe gave the following information: They couldn?t get a permit because the

house is existing non-conforming. They are going to follow the back line of

the house and pull straight out. They will be no closer to the rear property

line than the existing house. In the back of the house there is a big hill and

some apartments.



There was no opposition present to this appeal.

Mrs. Braxton made a motion, which was seconded by Mr. Phillips, to grant this

appeal because they will be no closer to the property line that the existing

house. Motion carried unanimously.



Case No. 02-V40?-Granted.



Ken Braswell and George Roffe presented the appeal of M. S. Jones Memorial

Church, 2216 Hamilton Road, for a variance to increase the exempt sign status

from 15 square feet to 48 square feet. There is 1 existing sign on the lot,

which will be removed before the new sign is constructed. The property is

zoned R-4.



In their statements and in response to questions from the Board Members, Mr.

Braswell and Mr. Roffe gave the following information: In October Mr. Roffe

came to Inspections & Codes to find out what was the restriction to keep him

from renewing his sign on the church property on Hamilton Road. The

information they gave him was correct, but they didn?t give him enough

information. They didn?t tell him about R-4 zoning and what could be put in an

R-4 zone, until he had already paid for the sign. When Mr. Braswell applied

for the permit to put the sign up, it was refused. There is an existing sign

on a metal pole. He has a lighted sign that will improve the look of the

place.

There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mrs. Braxton, to grant this appeal

because they will be replacing an existing sign. This is a commercial area,

but they just happened to be locked into an area that is zoned residential.

Motion carried unanimously.



Case No. 02-V41?-Granted.



Ken Brown, Leary & Brown, Inc., 4684 Talamore Lane, presented the appeal for a

variance to reduce the rear yard setback requirement from 30 feet to 7 feet, in

order to erect a single family residence. The property is zoned R-3A.

In his statement and in response to questions from the Board Members, Mr. Brown

gave the following information: This is the 0 lot line yard home section of

Maple Ridge. They are asking for a 7 feet setback requirement. This area is

part of Ballantyne. There have been other variances similar to this one in the

past.

There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal

because based on the type subdivision that this is, there are other houses

built the same way. Looking at the overall site plan it seems to make sense

based on the location of these garages. These are perpendicular to the lots.

The back yard would be more open than this would be if it was just backing up

to another house right next to it. There have been similar variances like this

one in the past. Motion carried unanimously.



Case No. 02-V42--Granted.



Ken Brown, Leary & Brown, Inc., 4690 Talamore Lane, presented the

appeal for a variance to reduce the rear yard setback requirement from 30 feet

to 12 feet, in order to erect a single family residence. The property is zoned

R-3A.



In his statement and in response to questions from the Board Members, Mr. Brown

gave the following information: These two lots are next to one another (4684 &

4690 Talamore Lane). This is the 0 lot line yard home section of Maple

Ridge. This area is part of Ballantyne. There have been other variances

similar to this one in the past.

Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal

because based on the type subdivision that this is, there are other houses

built the same way. Looking at the overall site plan it seems to make sense

based on the location of these garages. These are perpendicular to the lots.

The back yard would be more open than this would be if it was just backing up

to another house right next to it. There have been similar variances like this

one in the past. Motion carried unanimously.



Case No. 02-V43--Granted.



Robert Thompson, 3548 Green Forest Drive, presented the appeal for a variance

to reduce the side yard setback requirement from 8 feet to 1 foot 6 inches, in

order to make an addition, a carport, 13? x 33?, to a single family residence.

The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Thompson gave the following information: He would like to put a carport over

an existing slab. The same materials will be used to match the house. The

water will flow to the street and the back yard.



There was no opposition present to this appeal.



Mrs. Braxton made a motion, which was seconded by Mr. Fox, to grant this appeal

because the carport will be over an existing slab. The same materials will be

used to match the house. This is a nicely designed structure. Motion carried

unanimously.



Case No. 02-V44--Denied.



Robert Bailey, #2 Oliver Court, presented the appeal for a variance to

reduce the side yard setback requirement from 8 feet to 6 inches, in order to

install a free standing carport. The property is zoned R-1A.

In his statement and in response to questions from the

Board Members, Mr. Bailey gave the following information: He has a temporary

carport because his neighbor has walnut trees and the walnuts fall on his car.

Eventually he would like a permanent carport. He would have to get a variance

because it would be too close to the neighbor?s property line.



When the Chairman asked for opposition, John Roper, Roy Dean, Bill Murphy,

William Elk, Donald Mortenson and Pansy Roper came forward. There was a

letter also from Christine Weaver and Maureen Forston. There concerns are:



1) not in keeping with the quality of workmanship and materials in any of the

surrounding residential dwelling places.

2) inconsistent with the harmony and external design of the existing structures

even on lot 35 where it lies situate.

3) in plain and obstructive view of the external living areas of lots 32, 33

and 34 adjacent to it and is considered by those owners, respondents, to be

unsightly and offensive.

4) striking in appearance and immediately noticeable from adjacent properties

5) lying situate upon an established drainage easement.



Mr. Fox made a motion, which was seconded by Mr. Phillips, to deny this appeal

because an accessory structure is not permitted in the side yard. There was

opposition to this appeal. The accessory structure must be taken down within 31

days. Motion carried unanimously.



Case No. 02-V45--Granted.



Robert Nichols presented the appeal of Kim & Ed Riley, 4756 Bridlewood

Drive, for a variance to reduce the side yard setback requirement from 8 feet

to 1 inch, in order to make an addition, a carport, 23? x 28?, to a single

family residence. The property is zoned R-2.

In his statement and in response to questions from the Board Members, Mr.

Nichols gave the following information: They would like to add a double

carport to their home, presently they only have room for a single carport.

There is an existing slab. The same materials will be used to match the

house.



There was no opposition present to this appeal.



Mrs. Braxton made a motion, which was seconded by Mr. Phillips, to grant this

appeal because the carport will be over an existing slab. Although they will

have to widen it in order to accommodate it. There is a similar carport in the

area. Motion carried unanimously.



Case No. 02-V46--Granted.



Robert Kidd, M.C.S.D., 3100 Macon Road, presented the appeal for a

variance to increase the maximum height requirement from 50 feet to 90 feet, in

order to erect a library. The property is zoned C-2.



In his statement and in response to questions from the Board Members, Mr. Kidd

gave the following information: The center part of the library will be the

tallest. Although other portions of the building also exceed the 50 feet

height variation, that is the tallest part of the structure. It is currently

at 88 feet 8 inches above the finished floor of the building. They don?t

anticipate it getting any taller than 90 feet. There is no occupied space at

that height. The building is a 3 story building. It will bring natural light

into the building and provides an architectural affect.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal

because this is a landmark building to the city of Columbus. I am sure that

quite a bit of architectural thought has gone into it for the size, shape and

location of the property so that it looks right. I am confident that these

architects have the best interest of the city in mind in what the structure

should look like. Motion carried unanimously.

There was a letter of opposition from Mr. Joseph Blair. He stated, Mr.

Kirkland has been using his residence to operate a landscaping business for

well over one year already without obtaining this certificate. He already

parks his business?s landscaping trailer in front of his garage and places it

in the rear of his lot in the evenings. Landscaping businesses use a variety

of chemicals that are commercial grade and they require storage of commercial

quantities of chemicals, fertilizers, herbicides and pesticides. If he is not

mistaken, the lot also is in a 100 year flood zone on which a creek passes

through. This type of business also requires extensive use of internal

combustion gasoline equipment that requires maintenance. A landscaping

business clearly violates Section #23-3 that states, Such home occupation shall

not include the use of chemicals, matter or energy that may create or cause to

be created noises, noxious odors or hazards that will endanger the health,

safety or welfare of the community. From a personal standpoint, Mr. Kirkland

and his wife maintain their property to the highest standard and are very

welcomed residential neighbors.



Mr. Kirkland also stated, he does not have any chemicals that are commercial

grade. He will not use any chemicals, fertilizers, herbicides or pesticides.

He will not have extensive use of internal combustion gasoline equipment.

Hamilton Road Hardware does the maintenance on his mower. He does not plan on

creating any noise, obnoxious odors or hazards that will endanger the health,

safety or welfare of the community. He has not previously operated a lawn

business from his home. The trailer that he has is his father?s. He delivered

some furniture to their home because they just had a baby. His father has not
