SUBJECT: Condemnation of Property on St. Mary's Road Widening Project
INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator
Recommendation: Approval is requested for the acquisition of Parcel 37
(thirty-seven) on the above referenced project. 0.031 acres (1,359.65) square
feet), of land for right-of-away for County Road and/or Municipal Street
purposes, and authorizing the filing of a Declaration of Taking by the City
Attorney or his representatives for the acquisition of said lands under the
authority of the official code of Georgia annotated, Section 32-3-1 et.seq for
the St Mary's Road Widening Project.
Background: The parcel has to be condemned because the negoiations are
too, far apart. There were four contacts made and sincere discussion took
place. We asked for a counter offer to see if we could reach an ammenable
settlement. The owners are elderly, therefore, the son is the contact person.
A"Final Offer-10 Day Letter has been sent. Time has expired with no feedback.
Analysis: To keep the project on schedule it is necessary to proceed to
Condemn for Title and pay the money into Court, thereby allowing the City to
proceed with the project.
Financial Considerations: This project is funded by the CIP Funds.
Legal Considerations: The City Attorney agrees to this action.
Recommendations/ Actions: Approval is requested for the acquisition of Parcel 7
(seven) on the above referenced project. 0.014 acres (616.05) square feet), of
land for right-of-away for County Road and/or Municipal Street purposes, and
authorizing the filing of a Declaration of Taking by the City Attorney or his
representatives for the acquisition of said lands under the authority of the
official code of Georgia annotated, Section 32-3-1 et.seq for the St Mary's
Road Widening Project.
