The Regular Meeting of the Board of Zoning Appeals was held Wednesday, April 3,

2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

CASES TABLED FROM THE MARCH 6TH MEETING.



CASE NO. 02-HO47---Granted.



Thomas Johnson, 5907 Hunter Road, presented his application for a

Certificate of Occupancy for a Home Occupation for an office only for a siding

& roofing company, Maximum Siding & Roofing. The property is zoned R-1A.



In his statement and in response to questions from the Board Members,

the applicant gave the following information: He will be using an office

only. There will be no employees and no additional traffic. This will be full

time.



There was no opposition to this application.



Mr. Cargill made a motion, which was seconded by Mr. Fox, to grant this

application because it does meet the intent of the Home Occupation definition,

but with the stipulation that there will be no storage of work material at the

residence. Motion carried unanimously.

BOARD OF ZONING APPEALS ? 04/03/2002





VARIANCES.



Case No. 02-V47?-Granted.



Ray Phillips presented the appeal of Lewis Bunn, 1348 29th Street, for a

variance to reduce the front yard setback requirement from 25 feet to 17 feet,

in order to make an addition, an awning, 18? x 20?, to an office building. The

property is zoned M-1.





In his statement and in response to questions from the Board Members, Mr.

Phillips gave the following information: He is the owner of Ray Phillips

Siding. Mr. Lewis is the proprietor of the business and his partner. They

would like to install an aluminum carport. This is the only place they can put

the awning because there are doors in different locations of the

building.



There was no opposition present to this appeal.



Mr. Cargill made a motion, which was seconded by Mr. Billingsley, to grant this

appeal because the addition will be no closer to the front than the existing

building. There are doors that prevent him from putting the addition anywhere

else. Motion carried unanimously.



Case No. 02-V48?-Denied.



Jamie Gregory, 4449 Sims Street, presented the appeal for a variance to reduce

the side yard setback requirement from 8 feet to 1 inch, in order to make an

addition, 8? x 12?, a deck, to a single family residence. The property is

zoned R-1A.



In her statement and in response to questions from the Board Members, Ms.

Gregory gave the following information: They already have a deck in the side

yard. There is an incline on the side of the house. They have tried different

ways to keep the side from washing down. They built the deck so that when

someone comes in or out of the back door, they won?t be on the ground. They

have a sidewalk, but it still washes down when it rains and they do not want to

track mud into the house.

When the Chairman asked for opposition Richard Duncan came forward. He doesn?t

understand why Ms. Gregory has to have a deck. The deck should not be a place

for recreation. He has concerns with the visibility and the noise level.



Mr. Fox made a motion, which was seconded by Mr. Cargill, to deny this appeal

because they have other options. A hardship was not shown. The deck must be

taken down within 30 days. Motion carried unanimously.



Case No. 02-V49?-Granted.



D. L. Jordan presented the appeal of Nancy Martin, 2854 Lynda Lane, for a

variance to reduce the side yard setback requirement from 8 feet to 6 feet, in

order to make an addition, a bedroom & a bathroom, 12? x 16?, to a single

family residence. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Jordan gave the following information: Ms. Martin would like to add a bedroom

and bathroom to her home. The addition will not make an appreciable difference

in the appearance of the side yard. The same materials will be used to match

the house.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Cargill, to grant this

appeal because this will be a nice addition. The same materials will be used

to match the house. Motion carried unanimously.



Case No. 02-V50--Granted.



Connie Gilbert Baskin/The Barn at Lake Pines, 6300 Garrett Road,

presented the appeal from a Decision of the Building Official that an assembly

hall (recreation facility) is not permitted in an A-1 zoning. The property is

zoned A-1.

In her statement and in response to questions from the Board Members, Ms.

Baskin gave the following information: She operates The Barn at Lake Pines,

which is a rental facility for all types of corporate and private events. It

is a real rustic rural scenic area. There is a barn and a chapel on the

property. This has been a family business for over 20 years. She would like

to move an additional structure on the property and set it up to be used in

exactly the same way that she is using the other two buildings. It is a

vintage early 1900 shotgun house. She wants to dress it up like a doll house

and have it as an option for her customers who would like to have a more formal

setting for their event. She has signatures from her neighbors who do not

object to what she plans to do.



There was no opposition present to this appeal.



Mr. Cargill made a motion, which was seconded by Mr. Fox, to grant this appeal

because Ms. Baskin gave a very nice presentation. She talked to all of her

neighbors and they were not in opposition. The Building Official is correct

that an assembly hall (recreation facility) is not permitted in an A-1 zoning.

Motion carried unanimously.



Case No. 02-V51--Granted.



Michelle Gallops and her husband, 5033 Abbott Avenue, presented the appeal for

a variance to reduce the side yard setback requirement from 8 feet to 4 feet,

in order to make an addition, a bedroom, 14? x 25?, to a single family

residence. The property is zoned R-2.





In their statements and in response to questions from the Board Members, Mr. &

Mrs. Gallops gave the following information: They would like to add a bedroom

to their home. They can?t put the addition in the back because of the main

sewer. The same materials will be used to match the house.



There was no opposition present to this appeal.

Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant this appeal

because they can?t put the addition in the back because of the sewer. The same

Case No. 02-V52--Denied.



Tom Medley presented the appeal of Sheryl Simmons, 5724 Sanford Avenue,

for a variance to reduce the side yard setback requirement from 5 feet to 3

feet, in order to erect an accessory structure, a boat house, 14? x 25?. The

property is zoned R-2.



In his statement and in response to questions from the Board Members, Mr.

Medley gave the following information: He started a boat shelter. He had some

health problems and couldn?t finish it. It?s primarily a 4? x 4? pressure

treated post. He has 2? x 6?raftors across the top with fiberglass on it. If

he moves the shelter over, he will have to cut a tree down that is in the back

yard.



When the Chairman asked for opposition, Bobby Allen came forward. He has spent

a lot of time fixing up his property. He can see the structure from his

bedroom and it is not a pleasant site.



Mr. Phillips made a motion, which was seconded by Mr. Fox, to deny this appeal

because they have other options. A hardship was no shown. The accessory

structure must be taken down within 30 days. Motion carried unanimously.



Case No. 02-V53--Tabled.



Stan Swinehart, 527 Farr Road, presented the appeal from a Decision of

the Building Official that a sign is not allowed. The property is zoned R-4.

BOARD OF ZONING APPEALS ? 04/03/2002





In his statement and in response to questions from the Board Members, Mr.

Swinehart gave the following information: He would like to put a sign in front

of a mobile home park. There is a 30 foot driveway that enters the mobile home

park. They have a brick wall that is 5? feet high all around the entrance. He

had a portable sign out there through his own ignorance. The sign read

resident manager on duty on weekends and after hours inquire within because

they get a lot of drive by traffic when the office is not open. He was told he

could not have that sign because of the residential zoning. There is not a

private residence on the west side of Farr Road. He decided to get rid of the

portable sign and put up a nicer commercial sign. He was then told that he

already had one sign that read Parkwood Mobile Home Park and he needed a

variance to put up a second sign.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Fox, to table this appeal

until the May meeting because of the lack of proper information to make an

intelligent decision on the sign. They need photographs. Motion carried

unanimously.



Case No. 02-V54--Granted.



Comer Alexander presented the appeal of Donald Wilson, 2505 17th

Street, for a variance to reduce the rear yard setback requirement from 30 feet

to 26 feet, in order to make an addition, a laundry room, 8? x 12?, to a single

family residence. The property is zoned R-1A.





In his statement and in response to questions from the Board Members, Mr.

Alexander gave the following information: Mr. Wilson would like to add a

laundry room to his home. There is a back porch that is not covered, the

addition will not go any further than the steps to the porch. There will be a

door on the side. The same materials will be used to match the house.

There was no opposition present to this appeal.

Mr. Cargill made a motion, which was seconded by Mr. Fox, to grant this appeal

because Mr. Wilson has a large back yard and this will be a nice addition. The

same materials will be used to match the house. Motion carried unanimously.



Case No. 02-V55?-Granted.



David Cummings, 326 Farr Road, presented the appeal for a variance to reduce

the required number of parking spaces from 43 to 37, for mercantile use. The

property is zoned C-3.





In his statement and in response to questions from the Board Members, Mr.

Cummings gave the following information: They were building two stores at the

same time and they didn?t think about the flow going toward the road. The

parking space requirement for Family Dollar Stores on a national level is 32.

They have 6,600 sq. ft. of retail floor space in this approximately 8,000 sq.

ft. building. The rest is storage and bathrooms. They think the layout is

adequate for them and so does the user. It wasn?t their intent to have less

parking that was needed, but they already traded on the land.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Billingsley, to grant

this appeal because the number of parking spaces will dictate the customers.

If there are no parking spaces, the customers will not come to the store.

Motion carried unanimously.



Case No. 02-V56?-Granted.



Gail Aderhold, Action Buildings, presented the appeal of Rick Gladden, 776

Crestline Drive, for a variance to reduce the side yard setback requirement

from 5 feet to 1 foot, in order to make an addition, a carport, 13? x 26?, to a

single family residence. The property is zoned R-3.

BOARD OF ZONING APPEALS ? 04/03/2002





In her statement and in response to questions from the Board Members, Ms.

Aderhold gave the following information: Mr. Gladden would like a carport to

protect his mustang. He refurbishes cars. The rear yard of the property drops

off at a sharp angle and there is no other place to put the carport. There are

similar carports in the area.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant this appeal

because Mr. Gladden wants to protect his car. Motion carried unanimously.



Case No. 02-V57?-Tabled.



Ben Manry, 9100 River Road, presented the appeal from a Decision of the

Building Official that a sign is not allowed in an A-1 zoning. The property is

zoned A-1.



In his statement and in response to questions from the Board Members, Mr. Manry

gave the following information: This property was grand-fathered in when they

built the building in 1946 and they never changed the zoning. Most of the

businesses that have been in the building have had some type of signage. He

was told he needed to come down and make a special exception. He has done some

remodeling on the structure in recent times and he would like to put up a 4? x

8? double face sign hanging on a big cedar pole. On the other side he will

build a sign made out of scaffold jacks. It will be well within the setbacks

of the 3 feet. He is asking for two signs.



There was no opposition present to this appeal.



Mr. Cargill made a motion, which was seconded by Mr. Fox, to table this appeal

until the May meeting because they do not have enough visual information

(photos). Motion carried unanimously.



Case No. 02-V58?-Granted.



Rob McKenna presented the appeal of Adams Properties of Columbus, Inc., 2401

Whittlesey Road, for a variance to reduce the required number of parking spaces

from 54 to 45 for a restaurant. The property is zoned C-3.

BOARD OF ZONING APPEALS ? 04/03/2002







In his statement and in response to questions from the Board Members, Mr.

McKenna gave the following information: They recently had the building rezoned

to C-3. They now have to change the number of parking spaces due to the change

of use from 54 to 45 spaces. There are only 45 parking spaces on the site.

They are not sure if they can put 54 parking spaces on the site without taking

up every bit of green space on it.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal

because the number of parking spaces are adequate for this restaurant. Motion

carried unanimously.
